Plaintiffs, who operate small venue theaters in New York City, brought claims for declaratory and injunctive relief and nominal damages, alleging that the City’s Key to NYC program—which required certain indoor venues to check the COVID-19 vaccination status of patrons and staff before permitting entry—violated their rights to free speech and equal protection under the First and Fourteenth Amendments. Following the expiration of the Key to NYC program, the district court dismissed as moot Plaintiffs’ claims for declaratory and injunctive relief. The district court also dismissed Plaintiffs’ claim for nominal damages for lack of standing, concluding that Plaintiffs failed to plausibly allege an injury in fact. Plaintiffs now appeal that order.   The Second Circuit concluded that Plaintiffs have plausibly alleged Article III standing. However, the court affirmed the judgment of dismissal on the alternative ground of failure to state a claim. The court explained that Key to NYC does not impair a fundamental right because it does not violate Plaintiffs’ First Amendment rights. Nor does it target a suspect class. These are locations where large numbers of unassociated individuals are likely to gather and spend significant amounts of time exposed to one another, thereby posing a relatively high risk of spreading COVID-19. Requiring individuals in those settings to be vaccinated mitigated that risk and incentivized vaccination among the people most likely to be in a position to spread the virus. Plaintiffs brought a First Amendment challenge to the City of Kingston’s prohibition against bringing signs and posters into public meetings of the Common Council held at Kingston City Hall. The City moved to dismiss, arguing that Common Council meetings are limited public fora in which the City is permitted to reasonably restrict speech that undermines the purpose for which the forum had been opened. The district court granted the City’s motion, noting that government entities are permitted to regulate the manner in which the public participates in limited public fora. The district court concluded that Plaintiffs had not adequately alleged that the City’s sign prohibition was unreasonable in light of the potential disruption or distraction that signs at Common Council meetings might pose.   The Second Circuit affirmed. The court held that the Complaint itself and common sense offer a satisfactory rationale for the City’s sign prohibition, which undermines Plaintiffs’ assertions of unreasonableness. To be sure, there may be cases where restrictions on the form or manner of speech—including the use of signs—in a limited public forum would be unreasonable, but Plaintiffs have not pled such facts here. Plaintiff brought a Section 1983 claim against prison officials for their conduct during an electrical fire at Sing Sing Correctional Facility. Meanwhile, the prison officials claim that Plaintiff received a denial but failed to appeal. The district court determined that Plaintiff had not exhausted his administrative remedies and granted summary judgment to the officials. Plaintiff claimed that he received a denial and then appealed through the second and third stages of review.The Second Circuit vacated. The court explained that drawing all reasonable inferences in Plaintiff’s favor, there is a genuine dispute of material fact as to whether Plaintiff exhausted his administrative remedies. The prison officials may have mistakenly failed to consolidate Plaintiff’s grievance with those of the other inmates who were affected by the electrical fire—in a possible violation of state regulations requiring full consolidation. Plaintiff’s declaration is consistent with a belief that his grievance was denied as part of the consolidated group of grievants. He may have appealed that denial, but the prison system might not have a record of his appeal because it failed to record the denial of his initial grievance in the first place. Plaintiff’s declaration—combined with (1) the undisputed evidence that he filed an initial grievance, (2) the absence of documentary evidence that his complaint was ever denied, and (3) the apparent failure of the prison officials to consolidate his complaint with those of the other inmates—creates a dispute of material fact as to whether Plaintiff actually did pursue all administrative remedies that were “available” to him. 42 U.S.C. Plaintiff, pro se and incarcerated, appealed from the dismissal of his 42 U.S.C. Section 1983 action. The district court dismissed his complaint, concluding that Plaintiff was barred from proceeding in forma pauperis (“IFP”) because he had accumulated three “strikes” under 28 U.S.C. Section 1915(g) of the Prison Litigation Reform Act (“PLRA”). At issue on appeal is whether (1) a res judicata dismissal and (2) a dismissal of an entire complaint on several alternative grounds—one of which qualifies as a strike under existing precedent—can constitute strikes under Section 1915(g).   The Second Circuit affirmed. The court explained that Section 1915(g) bars a prisoner from proceeding IFP, absent a showing of imminent danger, if on three or more occasions while incarcerated, he has brought an action or an appeal that was “dismissed on the grounds that it is frivolous, malicious, or fails to state a claim upon which relief may be granted.” The court reasoned that Section 1915(g) does not provide Plaintiff an opportunity to relitigate his prior cases. The court considered Plaintiff’s remaining arguments and concluded they are meritless. The district court correctly concluded that Griffin was barred by the PLRA’s three strikes provision from proceeding IFP, and, therefore, properly dismissed his complaint. View "Griffin v. Plaintiff, an aspiring sidewalk counselor, brought a First Amendment challenge to Westchester County’s recently enacted “bubble zone” law, which makes it illegal to approach within eight feet of another person for the purpose of engaging in “oral protest, education, or counseling” when inside a one-hundred-foot radius of a reproductive health care facility. The district court dismissed the complaint, holding that Plaintiff lacks standing to mount a pre-enforcement challenge to the bubble zone law and that, in any event, the Supreme Court’s decision in Hill v. Colorado, 530 U.S. 703 (2000) forecloses her First Amendment claim.   The Second Circuit vacated the district court’s ruling insofar as it dismissed Plaintiff’s suit for lack of standing. The court nevertheless affirmed the judgment on the merits because the district court correctly concluded that Hill is dispositive of Plaintiff’s First Amendment claim. The court concluded that Plaintiff has standing to seek pre-enforcement relief because she has pleaded sufficient facts to support a credible threat that Westchester County will enforce the bubble zone law if she pursues her stated intention to engage in sidewalk counseling. Appellants in these tandem appeals are each a parent of a disabled child. Arguing that his or her child was entitled to benefits under the Individuals with Disabilities Education Act (“IDEA”), 20 U.S.C. Section 1415(i), each parent brought an administrative action against his or her local education agency and prevailed. Subsequently, each parent brought a federal action for attorneys’ fees pursuant to 20 U.S.C. Section 1415(i)(3)(B). In each case, the district court awarded less attorneys’ fees than the parent requested, and the parents appealed.   The Second Circuit reversed the district court’s denial of travel-related fees in No. 21-1961 and remanded for further proceedings. The court otherwise affirmed the judgments of the district courts. The court found that it was persuaded that there was no abuse of discretion in the district court’s calculation of reasonable attorneys’ fees in each case. Further, the court wrote that the district courts that declined to award prejudgment interest did not abuse their discretion because “delays in payment” may be remedied by “application of current rather than historic hourly rates.” However, the court held that the district court abused its discretion when it denied any travel-related fees to M.D.’s counsel. A district court may permissibly adjust excessive travel costs. But the district court could not “eliminate all of the hours submitted by [CLF] as travel time” by denying travel-related fees altogether. View "H.C. v. NYC DOE, et al." on Justia Law

Plaintiff brought an action against several police officers and the City of New York, asserting various claims under 42 U.S.C. Section 1983 and New York state law based on his allegation that police officers falsely claimed that they observed him selling drugs. After his criminal trial, Plaintiff was acquitted of a drug sale charge and convicted of a drug possession charge. Plaintiff subsequently filed this civil action, and the district court dismissed all of Plaintiff’s claims.   The Second Circuit affirmed in part and vacated in part the district court’s dismissal of Plaintiff’s claims and remanded. The court wrote that it agreed with the district court’s dismissal of all of the federal claims except for the dismissal of Plaintiff’s due process claim based on the use of fabricated evidence regarding the drug sale charge of which he was acquitted. Specifically, the district court erred in concluding that because Plaintiff was arrested, detained, prosecuted, and convicted for drug possession simultaneous to the drug sale proceedings, this precludes, as a matter of law, his ability to plead a deprivation of liberty caused by the drug sale prosecution. Because the prosecution of an individual based on fabricated evidence may itself constitute a deprivation of liberty, even in the absence of custody or a conviction, Plaintiff was not required to show that his drug sale prosecution resulted in additional custody or a conviction in order to sufficiently allege a claim at the pleading stage. On January 6, 2014, Defendant Genting New York LLC, d/b/a Resorts World Casino New York City ("Genting"), closed the Aqueduct Buffet (the "Buffet"), a restaurant located inside the Resorts World Casino (the "Casino") where Plaintiffs worked. Genting gave Plaintiffs no notice of the closure, which took effect the same day and resulted in 177 employees being laid off. The next week, Plaintiffs filed a putative class action against Genting, alleging that its failure to provide notice violated the Worker Adjustment and Retraining Notification Act (the "WARN Act"), and New York Labor Law Section 860 et seq. (the "New York WARN Act"). On cross-motions for summary judgment, the district court denied Plaintiffs' motion and granted Genting's. On appeal, Plaintiffs argue that the district court erred in granting summary judgment for Genting because, they claim, a reasonable jury could only conclude that the Buffet was either an operating unit or a single site of employment under the WARN Acts.   The Second Circuit affirmed in part and vacated in part. The court explained that Genting is not entitled to summary judgment because a reasonable finder of fact could conclude that the Buffet was an operating unit. Likewise, there is also evidence in the record to support the conclusion that the Buffet was not an operating unit. It will be for the finder of fact at trial to weigh the evidence comprising the "somewhat mixed" record in this case to answer the question. The court concluded that the district court erred in granting summary judgment for Genting and in dismissing Plaintiffs' claims under the WARN Acts. View "Roberts v. Genting" on Justia Law

Parents and guardians of students with disabilities brought an enforcement action under the Individuals with Disabilities Education Act, alleging that the New York City Department of Education must immediately fund their children’s educational placements during the pendency of ongoing state administrative proceedings. Plaintiffs moved for a preliminary injunction, which the district court denied. Plaintiffs appealed from that denial.   The Second Circuit affirmed. As a threshold jurisdictional matter, the court held that although the Plaintiffs are not yet entitled to tuition payments for the portion of the school year that has yet to occur, their claims are nevertheless ripe because they also seek payments for past transportation costs. On the merits, the court held that the IDEA’s stay-put provision does not entitle parties to automatic injunctive relief when the injunctive relief concerns only educational funding, not placement. Applying the traditional preliminary injunction standard, the court concluded that Plaintiffs are not entitled to the relief they seek because they have not shown a likelihood of irreparable injury. Plaintiff appealed from the district court’s judgment dismissing all claims against Defendants-Newburgh Enlarged City School District, Superintendent, and Assistant Superintendent. Plaintiff, an African American woman of West Indian descent who served as principal of South Middle School, asserts claims of discrimination under Title VII of the Civil Rights Act of 1964 and the Equal Protection Clause of the Fourteenth Amendment.   The Second Circuit affirmed the district court’s dismissal of the Title VII claim to the extent the claim is based on alleged adverse employment actions in May 2019 and vacated the district court’s judgment to the extent it dismissed the Section 1983 claim and the remainder of the Title VII claim. The court remanded the case to the district court for further proceedings, including a determination as to whether Plaintiff should be provided with an extension of time to effectuate proper service as to the Superintendent and Assistant Superintendent. The court explained that taking the allegations in the FAC as true and drawing all reasonable inferences in Plaintiff’s favor, the FAC meets that pleading standard with respect to the denial of the position for RISE administrator, the denial of her application to administer the summer-school program, and the termination of her position as SMS principal. Accordingly, the court explained that Plaintiff has stated plausible discrimination claims under Title VII and Section 1983, and the district court erred in dismissing them. Therefore, Plaintiff may proceed with her Section 1983 claim as to all three alleged adverse employment actions and with her Title VII claim against the School District. View "Buon v.
