Bockman-Fryberger v. State
The Supreme Court affirmed the decision of the district court refusing to strike for cause a juror who was a state employee in this action filed against the State to recover damages for injuries sustained in a collision with a vehicle owned and operated by the Montana Department of Transportation.Plaintiff sued the State for its employee’s negligence. After a trial, a jury found Plaintiff fifty-one percent at fault in the accident. On appeal, Plaintiff challenged the district court’s refusal to excuse a juror for cause due to his employment with the State. The Supreme Court affirmed, holding that the district court did not abuse its discretion by denying Plaintiff’s challenge for cause because the juror demonstrated that he could act with entire impartiality. Lincoln v. BNSF Railway Company
Several years after a tank car spill accident, appellants Larry Lincoln and Brad Mosbrucker told their employer BNSF Railway Company (“BNSF”) that medical conditions attributable to the accident rendered them partially, permanently disabled and prevented them from working outdoors. BNSF removed appellants from service as Maintenance of Way (“MOW”) workers purportedly due to safety concerns and because MOW work entailed outdoor work. With some assistance from BNSF’s Medical and Environmental Health Department (“MEH”), Appellants each applied for more than twenty jobs within BNSF during the four years following their removal from service. After not being selected for several positions, Appellants filed charges with the Equal Employment Opportunity Commission (“EEOC”), accommodation request letters with BNSF, and complaints with the Occupational Safety Health Administration (“OSHA”). Following BNSF’s rejection of their applications for additional positions, Appellants filed a complaint raising claims for: (1) discrimination under the Americans with Disabilities Act (“ADA”); (2) failure to accommodate under the ADA; (3) retaliation under the ADA; and (4) retaliation under the Federal Railroad Safety Act (“FRSA”). Relying on nearly forty years of Tenth Circuit precedent, the district court concluded that filing an EEOC charge was a jurisdictional prerequisite to suit and it dismissed several parts of Appellants’ ADA claims for lack of jurisdiction. Appellants also challenged the vast majority of the district court’s summary judgment determinations on the merits of their claims that survived the court’s exhaustion rulings. After polling the full court, the Tenth Circuit overturn its precedent that filing an EEOC charge was a jurisdictional prerequisite to suit, thus reversing the district court’s jurisdictional rulings. Appellants’ ADA discrimination and ADA failure to accommodate claims relative to some of the positions over which the district court determined it lacked jurisdiction were remanded for further proceedings. With respect to the district court’s summary judgment determinations on the merits of appellants’ claims that survived the exhaustion rulings, the Tenth Circuit was unable to reach a firm conclusion on the position-based ADA discrimination and failure to accommodate claims. The Court concluded the district court’s dismissal of the FRSA claims were appropriate. Therefore, the Court reversed in part, affirmed in part and remanded this case for further proceedings. Walsh v. Wahlert
The Supreme Court affirmed in part and reversed in part the judgment of the district court granting summary judgment in favor of Defendants on Plaintiff’s claims challenging his termination.Plaintiff, a former chief administrative law judge of the Unemployment Insurance Appeals Bureau in Iowa Workforce Development (IWD), alleged retaliation under the whistleblower protection provisions of Iowa Code 70A.28 and that Defendants continued to retaliate against him when he sought other positions in state government. Plaintiff further alleged wrongful termination in violation of public policy based upon the same conduct. The district court granted summary judgment for Defendants, concluding that Plaintiff could not bring his claims because he failed to exhaust his administrative remedies available to merit employees. The Supreme Court reversed in part, holding (1) Plaintiff’s ability to bring a direct claim under section 71A.28 is not precluded by the availability of an administrative remedy under Iowa Code 8A.415; and (2) the district court correctly granted summary judgment on Plaintiff’s wrongful termination claim. Doe v. Trustees of Boston College
The First Circuit vacated in part the district court’s grant of summary judgment in Defendants’ favor on Plaintiffs’ claims seeking compensatory damages, declaratory relief, a permanent injunction, and expungement of disciplinary proceedings from a student’s university records.John Doe was accused of sexually assaulting a fellow Boston College student. In 2012, Boston College held disciplinary proceedings against Doe, and an Administrative Hearing Board found Doe responsible for the lesser offense of indecent assault and battery. In 2014, Boston College conducted an independent review of the disciplinary proceedings and determined that the Board’s finding was proper. Doe and his parents filed a lawsuit against Trustees of Boston College and several university officials. The district court granted summary judgment in favor of Defendants on all counts. The First Circuit (1) affirmed the district court’s grant of summary judgment as to Plaintiffs’ breach of contract claim for the 2014 review and Title IX, negligence, and negligent infliction of emotional distress claims; and (2) vacated the grant of summary judgment as to Plaintiffs’ breach of contract claim for the 2012 disciplinary proceedings, where there were genuine issues of material fact on this claim, and basic fairness claim, where the grant of summary judgment on this claim rested on the court’s analysis as to Plaintiffs’ breach of contract claim. Gorman v. State of Mississippi
During a preliminary safety briefing before a firearms training exercise hosted by the Mississippi Gaming Commission, instructor and former Commission Special Agent Sharp forgot to replace his real firearm with a “dummy” firearm. Sharp accidentally discharged his real firearm against fellow instructor and Mississippi Gaming Commission Special Agent Gorman. Gorman subsequently died from the gunshot wound. In a suit under 42 U.S.C. 1983, the Fifth Circuit reversed the district court’s denial of Sharp’s motion for judgment on the pleadings based on qualified immunity. To defeat qualified immunity in a Fourth Amendment claim, the plaintiff must demonstrate both a bona fide Fourth Amendment violation and that the violation was clearly established at the time of the official’s conduct. Under established Supreme Court precedent, a Fourth Amendment seizure does not occur whenever there is a governmentally caused termination of an individual’s freedom of movement but only when there is a governmental termination of freedom of movement through means intentionally applied. "There is no question about the fundamental interest in a person’s own life, but it does not follow that a negligent taking of life is a constitutional deprivation." Harmon v. Jackson
The Supreme Court reversed the circuit court’s grant of summary judgment and dismissal of Plaintiff’s civil rights and tort complaint on the ground of failure to exhaust administrative remedies.Plaintiff, an inmate incarcerated in the Arkansas Department of Correction (ADC), filed a complaint against ADC officials in their individual capacities under the Arkansas Civil Rights Act of 1993 (ACRA), Ark. Code Ann. 16-123-101 to -108. Plaintiff alleged that Defendants violated his due process rights when they failed timely to release him from punitive isolation and that Defendants committed the torts of false imprisonment, negligence, and excessive confinement. The circuit court found that Plaintiff had failed to exhaust his due process and tort claims as required by the Prison Litigation Reform Act (PRLA), 42 U.S.C. 1997e. Because the PRLA is a federal law that is not applicable to actions brought against public officials in their individual capacities under ACRA and Arkansas tort law, the circuit court erred in granting Defendants’ motion for summary judgment and dismissing Plaintiff’s case for failure to exhaust. Gallop v. Adult Correctional Institutions
The Supreme Court vacated the judgment of the superior court and remanded this case to the superior court with directions to hear and decide Plaintiff’s motion to amend his complaint upon the merits, holding that the trial justice erred in failing to address Plaintiff’s motion to file a second amended complaint.Plaintiff, an inmate, filed an amended civil complaint alleging negligence on the part of State defendants. Before trial, the trial justice sua sponte raised the issue of the civil death statute in light of Plaintiff’s sentences of life imprisonment. Defendants then filed a motion to dismiss the case under R.I. Gen. Laws 13-6-1, arguing that Plaintiff was deemed civilly dead, and therefore, his civil rights were effectively terminated. Plaintiff then filed a motion for leave to file a second amended complaint seeking to add a claim for violations of Plaintiff’s constitutional rights under color of law. The trial justice granted Defendants’ motion to dismiss based on the civil death statute and did not address Plaintiff’s motion for leave to file a second amended complaint. The Supreme Court held that the trial justice accurately dismissed the case but should have addressed Plaintiff’s second amended complaint before granting Defendants’ motion to dismiss. State ex rel. Church & Dwight Co. v. Honorable William B. Collins
The Supreme Court made permanent preliminary writs of prohibition sought by Relators to prevent the circuit court from taking any action other than vacating its orders overruling their respective motions to dismiss on the grounds that Plaintiff’s Missouri Human Rights Act (MHRA) claims against them for discrimination and retaliation were time barred.After Relators each filed a motion to dismiss as time barred Alicia Mulvey’s MHRA claims for discrimination and retaliation, Mulvey filed a motion for leave to amend her petition to include common law claims of negligence and wrongful discharge. The circuit court overruled Relators’ motions to dismiss and sustained Mulvey’s motion for leave to amend. The Supreme Court held that the circuit court exceeded its authority when it overruled Relators’ motions to dismiss for failure to state a claim and abused its discretion when it sustained Mulvey’s motion for leave to amend her petition because Mulvey failed to file her MHRA claim within the ninety-day statutory period and her common law claims of negligence and wrongful discharge were fully encompassed and comprehended by the MHRA. Redmond v. Crowther
This appeal arose from prison officials’ attempt to gain control over an agitated prisoner who refused to obey their orders, locked himself in the prison’s outdoor recreation yard, and threatened prison officials. Officials decided to drop tear gas into the recreation yard. An intake vent in the yard drew the gas in and filtered it into the prison. Numerous prisoners in their cells were exposed to the gas. Prison officials evacuated the prisoners housed in two sections of the prison after they secured the prisoner in the recreation yard. The officials did not, however, evacuate the prisoners in two other sections. On behalf of a class of about one-hundred prisoners, Timothy Redmond sued three of the prison officials for constitutional violations under 42 U.S.C. 1983, claiming the officials violated the Eighth Amendment and Utah’s Constitution by exposing the prisoners to gas, and then failing to provide adequate medical care. The district court granted the defendants’ summary judgment motion. After review of the claims, the Tenth Circuit affirmed: the prison officials’ conduct, at most, only accidently exposed the prisoners to CS gas, and qualified immunity shields government officials from liability for mistakes like this one. And the rest of Redmond’s claims failed either because Redmond forfeited them, failed to prove a constitutional violation occurred, or did not cite case law that clearly established the alleged rights. Furthermore, violating the Utah Constitution required more-than-negligent conduct, and the prison officials’ conduct was “textbook negligence.” View "Redmond v. Crowther" on Justia Law
