Family PAC filed suit alleging that three provisions of the Washington election law violated the First Amendment as applied to ballot measure committees. The district court granted summary judgment in part for Family PAC and Family PAC subsequently sought attorneys fees and expenses. The court held that the term "costs" under Rule 39 of the Federal Rules of Appellate Procedure did not include attorney's fees and recoverable as part of costs under 42 U.S.C. 1988 and similar statutes. Therefore, in this case, the district court properly concluded that the statement in the court's previous opinion that "[e]ach party shall bear its own costs of appeal," did not preclude Family PAC, as prevailing party, from obtaining an award of appellate attorney's fees under section 1988. Defendant is a Texas law firm engaged in an advertising campaign to solicit former dental patients from Kool Smiles dental clinics as potential clients. On appeal, defendant challenged the district court's denial of its Texas anti-SLAPP motion brought under the Texas Citizen's Participation Act (TCPA), Tex. Civ. Prac. & Rem. Code Ann. 27.001-27.011, to dismiss a claim brought by Kool Smiles. The court held that it had jurisdiction to interlocutorily consider the denial of a TCPA anti-SLAPP motion to dismiss; because Kool Smiles waived its argument that the TCPA was a procedural law that conflicted with the Federal Rule of Civil Procedure, the court assumed that it did not; and the Supreme Court of Texas would most likely hold that defendant's ads and other client solicitations were exempted from the TCPA's protection because defendant's speech arose from the sale of services where the intended audience was an actual or potential customer. Plaintiff filed suit claiming malicious prosecution and violations of his civil rights. After plaintiff's attorney failed to comply with discovery deadlines, the district court dismissed plaintiff's suit with prejudice for failure to prosecute and failures to comply with a court order and the Federal Rules of Civil Procedure. The court concluded that, in these circumstances, it was an abuse of discretion to impose the "ultimate sanction" of dismissal with prejudice without first considering the viability of lesser sanctions. In 1985, a manager was shot to death during a robbery of his restaurant. In the following months, a second manager was murdered and another survived similar robberies. In each restaurant, the robber fired two .38 caliber bullets; all six bullets were recovered. The survivor, Smotherman, described his assailant and picked Hinton’s picture out of a photographic array. The police arrested Hinton and recovered from his house a .38 caliber revolver belonging to his mother, who shared the house. The Alabama Department of Forensic Sciences concluded that the six bullets had all been fired from the Hinton revolver. Hinton was charged with two counts of murder. He was not charged with the Smotherman robbery. The prosecution strategy was to link Hinton to the Smotherman robbery by eyewitness testimony and forensic evidence about the bullets and to persuade the jury that, given the similarity of the crimes, Hinton must have committed the murders. Hinton presented witnesses in support of his alibi that he was at work at the time of the Smotherman robbery. The six bullets and the revolver were the only physical evidence. Hinton’s attorney obtained a grant of $1,000 to hire an expert to challenge that evidence and did not request more funding, nor correct the judge’s mistaken belief that a $1,000 limit applied. Under that mistaken belief, Hinton’s attorney found only one person who was willing to testify: Payne. Hinton’s attorney believed that Payne did not have the necessary expertise. The prosecutor discredited Payne. The jury convicted Hinton; the court imposed a death sentence. In state post-conviction proceedings, Hinton alleged ineffective assistance and produced three highly credible experts, who testified that they could not conclude that any of the bullets had been fired from the Hinton revolver. The state did not submit rebuttal evidence. Following a remand by the state’s highest court, the trial court held that Payne was qualified to testify as a firearms and toolmark expert under the then-applicable standard. The Alabama Supreme Court denied review. The U.S. Supreme Court vacated and remanded, holding that Hinton’s attorney rendered ineffective assistance under its “Strickland” test. It was unreasonable to fail to seek additional funds to hire an expert where that failure was based not on any strategic choice but on a mistaken belief that available funding was limited. Off-duty Officer Macon argued with Richardson about Macon’s former girlfriend. Macon fired his gun at Richardson but missed. When on-duty officers arrived, Macon said that Richardson had struck him with a baseball bat. Richardson was arrested and charged with assault and battery. After the charges were dismissed, Richardson filed suit, with 39 claims under 42 U.S.C. 1983 and state law against Chicago, Macon, the arresting officers, and others. Chicago was dismissed before trial because municipalities are not vicariously liable under section 1983, and the district judge found that none of the city’s policies (including its training regimens) was constitutionally deficient. The jury rejected claims against the other defendants, but decided in Richardson’s favor on one claim, concerning the shot Macon fired, and awarded $1 in nominal damages plus $3,000 in punitive damages. Macon did not appeal, nor did Chicago, which under Illinois law must indemnify Macon for the $1 but not the punitive award. Pursuant to 42 U.S.C. 1988, Richardson sought more than $675,000 in fees. The district judge awarded $123,000, noting that the firm’s billing did not allow non‑compensable time to be separated out. Re and Leach owned warehouses in Englewood, Florida. After leasing space in Leach’s warehouse, Daughtry told his agent that he did so because Leach stated that a sewer line essential to Re’s warehouse crossed Leach’s property without permission and lacked permits. The agent shared the information who Re, who hired assailants to beat Leach and threaten worse unless he broke the lease. Re was convicted under the Hobbs Act, 18 U.S.C. 1951, for using extortion to injure Leach’s business in interstate commerce. The Seventh Circuit affirmed. In a petition under 28 U.S.C. 2255, Re claimed that his lawyers rendered ineffective assistance: trial counsel by stealing from Re and appellate counsel by omitting an argument certain to prevail. The district court denied the petition. The Seventh Circuit affirmed, rejecting an argument that threatening someone without “obtaining” money, or value, in return, does not meet the Hobbs Act definition. A jury could find that Re’s goal in having Leach beaten was to obtain Daughtry as a tenant to get rental payments. A post-trial crime by a lawyer against his client does not spoil the trial as a matter of law; prejudice must be shown. Re could not establish prejudice. The Iowa Supreme Court Attorney Disciplinary Board filed a complaint against Attorney Doe based on sexual misconduct allegations by the attorney's client, Jane Doe. The Grievance Commission of the Iowa Supreme Court scheduled a hearing on the matter. Jane's attorney requested a continuance of the scheduled hearing so that she could be present when Jane testified before the Commission. The Commission President quashed Jane's attorney's appearance and denied her request for a continuance, stating that witnesses testifying before the Commission were not entitled to have an attorney present during the proceedings and that that absence of Jane's attorney from the hearing would cause no unfairness to Jane. The Supreme Court reversed the Commission's order, holding that a person called upon to be a witness before the Commission may be represented by counsel for the limited purpose of protecting rights personal to the witness in the proceeding. Plaintiff, the first African-American circuit court judge elected in Phillips County, Arkansas, filed suit under 42 U.S.C. 1983 against the commission and officials during the disciplinary proceedings against him. The district court denied plaintiff's request for a temporary restraining order and stayed proceedings in accordance with the Younger abstention doctrine. The state disciplinary proceedings ended with a decision by the Arkansas Supreme Court. The district court then granted the commission and officials' Rule 12(b) motion to dismiss, finding no justifiable federal controversy. The court concluded that Defendant Stewart, Executive Director of the commission, was entitled to absolute prosecutorial immunity as to plaintiff's claims for damages on the first cause of action; plaintiff had no justiciable claim for damages against any defendant in the second cause of action where plaintiff's allegations amounted to nothing more than a state law defamation claim and the district court did not abuse its discretion; and plaintiff's requests for declaratory and injunctive relief were moot. Steidl and Whitlock were convicted of 1987 murders, largely based on testimony by two supposed eyewitnesses. Long after the convictions, an investigation revealed that much of the testimony was perjured and that exculpatory evidence had been withheld. The revelations led to the release of the men and dismissal of all charges. Steidl had spent almost 17 years in prison; Whitlock had spent close to 21 years. They sued. By 2013, both had settled with all defendants. Because the defendants were public officials and public entities, disputes arose over responsibility for defense costs. National Casualty sought a declaratory judgment that it was not liable for the defense of former State’s Attorney, McFatridge, or Edgar County, agreeing to pay their costs under a reservation of rights until the issue was resolved. The Seventh Circuit ruled in favor of National Casualty. In another case McFatridge sought a state court order that the Illinois Attorney General approve his reasonable expenses and fees; the Illinois Supreme Court rejected the claim. In a third case, National Casualty sought a declaratory judgment that another insurer was liable for costs it had advanced. The Seventh Circuit affirmed that the other company is liable. It would be inequitable for that company to benefit from National’s attempt to do the right thing, especially since it did not do the right thing and contribute to the defense costs under a reservation of rights. Bowers joined Ophthalmology Group as an employee in 1999 and, in 2002, became one of six partners. In November 2009, Bowers tendered a resignation letter to her partners. Although she did not give a date of departure, the partnership agreement required a one-year notice. In March, 2010, the partners voted to expel Bowers from the partnership, stating that her Chapter 7 bankruptcy and creditors’ proceedings and other personal conduct were detrimental to the Partnership.” After exhausting administrative remedies, Bowers filed suit, alleging: gender discrimination under Title VII; wrongful termination in breach of contract or in violation of public policy under Kentucky common law; gender discrimination under Kentucky statutes; retaliation for complaining about gender discrimination under Title VII, 42 U.S.C. 2000e. and the state law; and misappropriation of name for commercial advantage. Bowers moved to disqualify defendant’s counsel because another attorney at the firm previously represented Bowers in a substantially related matter. The district court granted summary judgment in favor of defendant because Bowers, as a former partner, was not an “employee” under Title VII and denied the motion to disqualify “as moot.” The Sixth Circuit vacated summary judgment and granted the motion to disqualify.View "Bowers v.
