Hidden Village, LLC v. City of Lakewood, OH
The Youth Re-Entry Program helps young people re-enter society after foster care or juvenile detention. About 80 percent of its members are black. The program moved to the Cleveland suburb, Lakewood, to house clients in apartments in Hidden Village. Lakewood’s building commissioner (Barrett) took the position that this was a prohibited institutional use. The program nonetheless moved into Hidden Village. Barrett ordered removal, but the planning commission reversed his decision. The police department sent officers a memo stating that “[c]itations and arrests are the preferred course of action for violations ... in the vicinity of [Hidden Village].” Program participants began complaining about harassment, such as tickets and astronomical fines for jaywalking, failure to attach a license plate to a bicycle, and walking on railroad tracks. The mayor stated that he intended to remove the program. Police, an officer in SWAT attire, a canine unit, and fire and health department workers visited Hidden Village, unannounced and without a warrant, to conduct a “joint inspection.” Another fire inspection followed a week later. Hidden Village sued, 42 U.S.C. 1981-1983. The Youth Program did not participate. The district court denied the defendants summary judgment and held that individual defendants did not enjoy qualified immunity. The Sixth Circuit affirmed in part. Sylvia Landfield Trust v. City of Los Angeles
Plaintiffs, four landlords, challenged the constitutionality of the City's Rent Escrow Account Program (REAP). The Housing Department places property into REAP when a landlord fails to repair habitability violations and tenants pay a reduced rent. The court concluded that placing plaintiffs' property into REAP did not violate plaintiffs' substantive due process rights where REAP served legitimate governmental goals and was rationally related to a legitimate governmental purpose; plaintiffs' procedural challenge could not support an as-applied substantive due process claim; and denial of leave to amend the complaint was not an abuse of discretion. Henry v. City of Erie
A 2010 fire at an apartment in Erie, Pennsylvania took the lives of a tenant and her guest. The third-floor bedroom purportedly lacked a smoke detector and an alternate means of egress, both of which are required under the Section 8 housing choice voucher program (42 U.S.C. 1437f) in which Richardson participated. The district court rejected a defense of qualified immunity in a suit under 42 U.S.C. 1983 by the estates of the deceased. The Third Circuit reversed. State officials’ approval and subsidization of the apartment for the Section 8 program, even though the apartment allegedly failed to comply with Section 8’s standards, did not constitute a state-created danger toward the apartment’s tenant and her guest in violation of their constitutional substantive due process rights.

Miami Valley Fair Hous. Ctr., Inc. v. Connor Grp.
Connor Group owns and manages about 15,000 rental units throughout the U.S., including about 1,900 in the Dayton area. Its rental agent posted an ad on Craigslist: 599/1br – Great Bachelor Pad! (Centerville) … Our one bedroom apartments are a great bachelor pad for any single man looking to hook up. This apartment includes a large bedroom, walk in closet, patio, gourmet kitchen, washer dryer hook up and so much more.... A fair-housing organization sued, charging violation of the Fair Housing Act’s section 3604(c) and Ohio’s Revised Code section 4112.02(H)(7), claiming that the bachelor pad ad was facially discriminatory to families and women. The court provided a jury instruction that “The question is not whether the particular advertisement discourages some potential renters from applying … but whether such discouragement is the product of any discriminatory statement or indication in the advertisement. If an ordinary reader who is a member of a protected class would be discouraged from answering the advertisement because of some discriminatory statement or indication contained therein, then the fair housing laws have been violated.” The trial court ruled in favor of the landlord. Lewis v. Jaeger
Tenant brought claims against her landlord, the City of Dubuque, and a City official (Defendants), asserting that they unlawfully caused her eviction from her apartment. Tenant alleged, among other things, that the conduct of Defendants violated a number of her statutory rights under the Iowa Uniform Residential Landlord and Tenant Act (IURLTA). To the extent the Dubuque ordinance authorized the action of Defendants, Tenant argued the ordinance was preempted by the IURLTA. The district court concluded that Tenant was entitled to the return of her security deposit but denied all other relief. The Supreme Court affirmed in part and reversed in part, holding (1) the ordinance was not preempted by the IURLTA and there was no violation of federal law in this case; (2) the ordinance was not unconstitutionally vague and any procedural due process claim was moot; (3) the landlord violated the IURLTA when he removed the belongings of Tenant from the apartment, and landlord's withholding of Tenant's security deposit was a bad faith violation of IURLTA. Remanded.
Stevens v. Hous. Auth. of South Bend
Plaintiff entered into a lease with the housing authority in 2007 as "Resident" and named her two sons as "Household Members." The lease provided that certain criminal activities could lead to immediate eviction. Plaintiff received a notice to vacate a few weeks later, after a visit by her daughter led to a gunfight in the parking lot. While plaintiff's challenge was pending, second and third notices issued. Police had been called to her apartment and determined that plaintiff had stabbed her husband, who was living at the apartment and was high on cocaine. Officers found joints on the counter. Plaintiff vacated. The district court granted summary judgment in favor of the defendants on federal claims and declined to exercise jurisdiction over state law claims. The Seventh Circuit affirmed. The case is moot because plaintiff never contested the second and third notices and, therefore, cannot be restored to the apartment; there was evidence that she lied on her application and was never eligible for tenancy. She incurred no expenses and state court proceedings provided all the process that was due. The court rejected a claim of emotional distress and a claim that the complex constituted segregated housing.
Ingram, et al. v. Oroudjian, et al.
Appellants appealed the district court's order awarding them attorney fees following settlement of their claims against appellees brought under the Fair Housing Act, 42 U.S.C. 3601-3619, and California law. At issue was whether the district court erred by deducting some of the hours billed and lowered the hourly rates requested by appellants. The court held that the district court did not abuse its discretion either by relying, in part, on its own knowledge and experience, or by setting an hourly rate of $350 for appellants' lawyers. Accordingly, the judgment was affirmed.
