Ogle works for the Ohio Department of Taxation. He is not a member of the union that represents the Department’s employees in collective bargaining. Under state law, the union may require non-members to pay “fair share” fees to defray the cost of collective-bargaining activities, Ohio Rev. Code 4117.09(C). In 2016-2018, the state deducted these fees from his pay without consent. In 2018, the Supreme Court held, in “Janus,” that compulsory “fair share” fees violate the free-speech rights of public employees, overruling its 1977 “Abood” decision authorizing such fees. Ogle filed a 42 U.S.C. 1983 action against the union, seeking a refund of the fair share fees he and others paid. In the meantime, the Sixth Circuit joined two other circuits in holding that public-sector unions that collected “fair share” fees in reliance on Abood may assert a good-faith defense to section 1983 lawsuits that seek the return of those fees. The Sixth Circuit then affirmed the dismissal of Ogle’s suit. Despite section 1983’s silence about defenses or immunities, the historical context from which the statute emerged indicates that a narrow good-faith defense protects those who unwittingly cross a line in reliance on presumptively-valid state law. Mascow, a teacher who had tenure under Illinois law, was laid off in 2017. Because her latest rating was “unsatisfactory,” she was first in line for layoff when the school lost one position and lacked any recall rights if the school district began hiring again—as it did. She sued under 42 U.S.C. 1983, alleging that the Due Process Clause entitled her to a hearing before the layoff and that the “unsatisfactory” rating violated the First Amendment. Mascow became co-president of the Union in 2010. Her First Amendment claim rests on her actions in 2014 and 2015 in notifying administrators that planned activities would violate the collective bargaining agreement. The school canceled one event and revised the other. The district court rejected both claims, reasoning that a reasonable jury could not find that the 2014 and 2015 meetings caused a reduction in Mascow’s ratings, noting that Mascow’s co-president, who attended the 2015 meeting, retained an “excellent” rating. The Seventh Circuit affirmed with respect to the First Amendment but vacated with respect to the due process claim. Neither the district judge nor the parties’ briefs addressed how teachers can obtain review of their ratings and whether those opportunities satisfy the constitutional need for “some kind of hearing.” View "Mascow v. The Fifth Circuit affirmed the district court's grant of plaintiff's motion for summary judgment in an action alleging that his former employer, BASF, discriminated against him in violation of the Americans with Disabilities Act (ADA) and the Age Discrimination in Employment Act (ADEA).The court held that plaintiff's ADA claim was properly dismissed, because plaintiff failed to offer any evidence of a causal connection between his discharge and his alcoholism. Furthermore, plaintiff failed to show that BASF's legitimate, nondiscriminatory reason for discharging him, the apparent positive results of his alcohol test and violation of company policy, was pretextual. Even if the court were to consider plaintiff's failure-to-accommodate argument, it would fail because the ADA does not provide a right to an employee's preferred accommodation but only to a reasonable accommodation. The court also held that plaintiff produced no evidence to support his ADEA claim and there was no abuse of discretion in the district court's decision not to mandate the requested production of his discovery request. On remand from the Supreme Court, the Ninth Circuit affirmed the district court's order denying defendant's motion for summary judgment on plaintiff's claims under the Equal Pay Act (EPA). The en banc court held that plaintiff's prior rate of pay was not a "factor other than sex" that allows Fresno County's Office of Education to pay her less than male employees who perform the same work. The en banc court also held that only job-related factors may serve as affirmative defenses to EPA claims.The en banc court wrote that the express purpose of the Act was to eradicate the practice of paying women less simply because they are women, and that allowing employers to escape liability by relying on employees' prior pay would defeat the purpose of the Act and perpetuate the very discrimination the EPA aims to eliminate. Therefore, the en banc court held that an employee's prior pay cannot serve as an affirmative defense to a prima facie showing of an EPA violation. The en banc court overruled Kouba v. Allstate Ins. Co., 691 F.2d 873 (9th Cir. 1982), which held that prior pay could qualify as an affirmative defense if the employer considered prior pay in combination with other factors and used it reasonably to effectuate a business policy. Plaintiffs filed suit against the school district and its superintendent, alleging free speech and retaliation claims in violation of their First Amendment rights under 42 U.S.C. 1983; Article 1, Section 8 of the Texas Constitution; and the Texas Whistleblower Act. Plaintiffs, the former principal and assistant principal of an elementary school, served on a 504 committee which convened for the purpose of implementing regulations under Section 504 of the Rehabilitation Act of 1973. Plaintiffs were terminated after an investigation determined that they intentionally authorized inappropriate student testing accommodations based on a misapplication of Section 504 eligibility requirements.The Fifth Circuit affirmed the district court's judgment, holding that the superintendent was entitled to qualified immunity because it was not clearly established at the time whether First Amendment liability can attach to a public official who did not make the final employment decision. The court also held that the district court did not err in granting summary judgment on plaintiff's First Amendment claims, because plaintiffs' calls to TEA regarding Section 504 construction and application at the elementary school were clearly activities undertaken in the course of performing their jobs and these actions were therefore not protected by the First Amendment.Finally, the court held that plaintiffs were not entitled to recover lost wages because they failed to exercise reasonable diligence to mitigate their damages; the district court did not err in denying plaintiffs' motion for rescission or modification; the district court did not err in instructing the jury that the IHE's findings were preclusive; and the district court did not err in relying on the jury's verdict that plaintiffs did not report a violation of law in good faith. The Second Circuit affirmed the district court's grant of defendants' motion to dismiss an action alleging violations of the Rehabilitation Act of 1973 and related state and municipal laws. Plaintiff also filed suit under 42 U.S.C. 1983 for the same alleged violations of the Rehabilitation Act.The court held that an employee cannot make a prima facie case against his employer for failure to provide a reasonable accommodation under the circumstances presented here. In this case, plaintiff failed to plausibly allege that defendants knew or should reasonably have known he was disabled; defendants were under no obligation to initiate the interactive process, and plaintiff's failure to affirmatively request an accommodation was a sound basis for dismissal of his claim. Lee, a public-school teacher, was required to either join the union or pay fair-share fees as a non-member because the collective bargaining agreement between the school district and the union included a fair-share clause. Lee paid fair-share fees. Anticipating that the Supreme Court would overrule its precedent endorsing fair-share fees (Abood), Lee filed a putative class action, asserting that the union and state actors had violated her constitutional rights by imposing compulsory fair-share fees as a condition of employment. She sought a declaration that provisions of Ohio law were unconstitutional and damages. Two days later, the Supreme Court issued its "Janus" decision, reasoning that fair-share fees resulted in non-members being “forced to subsidize a union, even if they choose not to join and strongly object to the positions the union takes in collective bargaining and related activities,” thereby violating the free speech rights of non-members. Lee dismissed her claims against the state officials and the school district. The Sixth Circuit affirmed the dismissal of the claims against the union. The union, as a private actor sued under 42 U.S.C. 1983, was entitled to rely on its good faith in following existing Ohio law and Supreme Court precedent. Plaintiff filed suit against current and former members of the Missouri State Highway Patrol, alleging that adverse employment actions were taken against him in retaliation for his protected First Amendment speech.The Eighth Circuit affirmed the district court's grant of summary judgment to defendants, holding that plaintiff's non-testimonial speech was not entitled to First Amendment protection. In this case, although it was undisputed that plaintiff spoke as a private citizen and his speech was of public concern, the highway patrol has shown sufficient evidence of disruption to the efficiency of its operations. Under the Pickering balancing test, the court held that the factors weighed in favor of the highway patrol's interest in efficiency and indicated that plaintiff's speech activity was more likely than not impeding his ability to perform his job duties as a police officer. Therefore, defendants were entitled to qualified immunity regarding plaintiff's speech to the family of the victim of a drowning accident, on social media, and to the news reporter. The court also held that the remaining testimonial speech was not a substantial or motivating factor in the adverse employment actions against plaintiff. The First Circuit affirmed the district court's grant of summary judgment on Appellant's federal law claims under the Age Discrimination and Employment Act, and on the state-law claims for discrimination, retaliation based on a complaint of age discrimination, and failure to investigate and vacated the summary judgment on the state law claims for retaliation based on a report of gender discrimination, breach of contract, intentional interference with contractual relations, and defamation, holding that the court erred in granting summary judgment as to these claims.This lawsuit arose from events that led to Appellant's retirement from his position as Fire Chief for the Fire Department of the Town of Marshfield, Massachusetts. The district court granted summary judgment in favor of the Town on all of Appellant's federal and state law claims. The First Circuit affirmed in part and vacated in part, holding (1) summary judgment was properly granted as to some of Appellant's claims; but (2) as to the remaining state law claims, there was no analogue to the common law claims in the federal law claims that were addressed, and rather than attempt to resolve the state law issues that were in dispute as to these claims, their dismissal was directed without prejudice. Jackson served in the Marine Corps, 1977-1991. Almost 30 years after his honorable discharge, Jackson filed a pro se complaint alleging that toward the end of his military career, his supervising officers discriminated against him because he is a black male, in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. 2000e. The district court inferred additional claims under the Administrative Procedure Act (APA), 5 U.S.C. 706(2)(A), and the Military Pay Act, 37 U.S.C. 204 but ultimately dismissed all of Jackson’s claims. The D.C. Circuit affirmed. The court noted the unanimous rulings of other sister circuits, concluding that Title VII does not apply to uniformed members of the armed forces. Jackson’s APA claim was untimely and, although the limitations period is no longer considered jurisdictional, the facts alleged were insufficient to apply equitable tolling. Jackson was able to manage his affairs and comprehend his rights; he alleged that at the time of the alleged discrimination, he knew that he “had been subjected to wrongdoing and strongly desired justice.” The court concluded that it lacked jurisdiction to review the dismissal of Jackson’s Military Pay Act claim; the Court of Appeals for the Federal Circuit has exclusive jurisdiction of such claims.
