Plaintiff was sixty-one years old when his employment with the Kansas City Chiefs was terminated. Plaintiff was replaced by a younger worker. Plaintiff filed a petition in the circuit court alleging a single act of age discrimination on the day of his termination. In pretrial proceedings, the trial court denied Plaintiff’s request to have testimony presented to the jury from numerous nonparty former employees over age forty who were either fired or pressured to resign and their job duties were assumed by younger replacements. The jury ultimately returned a verdict in favor of the Chiefs. The Supreme Court vacated the judgment, holding that the trial court (1) misapplied the legal standard for admission of evidence by so-called “me too” witnesses and abused its discretion in excluding “me too” evidence offered by the former employees; and (2) erred in excluding evidence concerning a discriminatory age-related statement allegedly made by a Chiefs executive and in quashing a deposition order issued to the Chiefs’ chairman and chief executive officer. Plaintiff filed suit against his employer, Amtrak, alleging that it discriminated against him because of his race in violation of Title VII of the Civil Rights Act, 42 U.S.C. 2000e et seq., and District of Columbia law. The district court granted summary judgment to Amtrak. After the engine plaintiff was driving passed a stop signal at the rail yard and was forced off the rails by a safety derailer, Amtrak fired him and suspended his engineer certificate. The court affirmed the judgment, concluding that no jury could reasonably conclude based on the evidence in the record that Amtrak was motivated by plaintiff's race to take the adverse actions of which he complains. Plaintiff filed a disability discrimination action under the Nebraska Fair Employment Practice Act, alleging that his Employer was aware of his disabilities and discriminated against him under the Act and that his Employer terminated his employment for violating standards or conditions of employment that did not apply to employees without disabilities. The jury returned a verdict for the Employer. The Supreme Court reversed, holding that the trial court erred in excluding testimony by a vocational rehabilitation counselor that was relevant to show the Employer’s knowledge and previous accommodation of Plaintiff’s mental impairments after a work-related accident, and the error was prejudicial. The jeopardy element of the tort for wrongful discharge against public policy and whether the administrative remedies available under the Surface Transportation Assistance Act of 1982 (STAA) were at issue in this case. This was one of three concomitant cases before the Washington Supreme Court concerning the "adequacy of alternative remedies" component of the jeopardy element that some of Washington cases seemingly embrace. The complaint here alleged that Anderson Hay & Grain Company terminated petitioner Charles Rose from his position as a semi-truck driver when he refused to falsify his drivetime records and drove in excess of the federally mandated drive-time limits. Rose had worked as a truck driver for over 30 years, the last 3 of which he worked as an employee for Anderson Hay. In March 2010, Rose sued under the STAA in federal court but his suit was dismissed for lack of jurisdiction because he failed to first file with the secretary of labor. Rose then filed a complaint in Kittitas County Superior Court, seeking remedy under the common law tort for wrongful discharge against public policy. The trial court dismissed his claim on summary judgment, holding that the existence of the federal administrative remedy under the STAA prevented Rose from establishing the jeopardy element of the tort. The Court of Appeals affirmed. The Supreme Court remanded the case back to the appellate court for reconsideration in light of "Piel v. City of Federal Way," (306 P.3d 879 (2013)). Like the statute at issue in Piel, the STAA contained a nonpreemption clause. On remand, the Court of Appeals distinguished Rose's case from Piel, and again affirmed the trial court's decision. Upon review, the Supreme Court addressed the cases the Court of Appeals used as basis for its decision, and held that adequacy of alternative remedies component misapprehended the role of the common law and the purpose of this tort and had to be stricken from the jeopardy analysis. Plaintiff Erika Rickman brought this suit against her former employer, Premera Blue Cross, for wrongful discharge in violation of public policy. Rickman alleged she was terminated in retaliation for raising concerns about potential violations of the federal Health Insurance Portability and Accountability Act of 1996, and its Washington counterpart, the Uniform Health Care Information Act (UHCIA). The trial court dismissed Rickman's suit on Premera's motion for summary judgment, concluding Rickman could not satisfy the jeopardy element of the tort because Premera's internal reporting system provided an adequate alternative means to promote the public policy. The Court of Appeals affirmed. The Washington Supreme Court granted review of this case and two others in order to resolve confusion with respect to the jeopardy element of the tort of wrongful discharge in violation of public policy. Consistent with its decisions in the other two cases, the Court held that nothing in Premera' s internal reporting system, nor in HIPAA or UHCIA, precluded Rickman's claim of wrongful discharge. The Court reversed the Court of Appeals but remanded for that court to address Premera's alternate argument for upholding the trial court's order of dismissal. View "Rickman v. In 2004, Akron administered promotional examinations for firefighters for the ranks of Lieutenant and Captain. Akron firefighters who took the examinations, but were not promoted, filed suit, alleging that the promotional process disparately impacted firefighters over the age of 40 in violation of the Age Discrimination in Employment Act, 29 U.S.C. 621, and Ohio Revised Code 4112.02, .14, and .99 and that the Lieutenant promotional process adversely impacted African-American applicants, and the Captain promotional process adversely impacted Caucasian candidates in violation of Title VII, 42 U.S.C. 2000e., and Ohio Revised Code 4112.02(A). A jury found that the two promotional processes adversely impacted applicants over the age of 40, and that the exams and promotional processes were not justified by business necessity. The district court entered an award of back pay of $616,217.75, entered a permanent injunction, and appointed a court monitor. The Sixth Circuit affirmed the liability judgment, reversed the back-pay award, remanded for reassignment to a different district judge and a new trial on the issue of back pay, and modified the order to limit the court monitor’s involvement to one promotional cycle. Claimant Roxanne Moran appealed a superior court's dismissal of her complaint for lack of jurisdiction. Claimant, a former employee of the Vermont State Hospital, separated from state service and applied for ordinary disability-retirement benefits in November of 2011. The Medical Review Board denied benefits, and claimant requested an evidentiary hearing after which benefits were again denied. Claimant then pursued an appeal to the superior court under Vermont Rule of Civil Procedure 75. The court dismissed the action for lack of jurisdiction, and claimant appealed. On appeal, claimant argued that because the superior court had jurisdiction over the appeal the Rule 75 action should not have been dismissed. In the alternative, claimant argued that, even if the superior court did not have jurisdiction to review the Board's decision, her timely filed Rule 75 complaint was sufficient to preserve the Supreme Court's jurisdiction under Vermont Rules of Appellate Procedure 3 and 4. In addition to its brief directly responding to claimant's arguments on appeal, the State also filed a motion to dismiss a portion of the appeal as untimely. Finding no reversible error and that the superior court indeed lacked jurisdiction to hear claimant's appeal, the Supreme Court affirmed. View "Moran v. Vermont State Retirement Board" on Justia Law

Bisluk, a conservative who votes Republican, was a special agent working in Chicago for the Illinois Department of Revenue’s Liquor Control Commission under former Illinois Governor Rod Blagojevich’s Democratic administration. She purchased a home in southern Illinois and asked her employer about transferring duty assignments from Chicago to southern Illinois, but failed to submit a transfer request or apply for the job. She did not get a position. She sued several state officials alleging that she was denied a transfer to southern Illinois because of her political association, in violation of the First Amendment and because of her gender in violation of the Equal Protection Clause. The Seventh Circuit affirmed summary judgment in favor of the defendants. The undisputed evidence showed that Bisluk did not receive the transfer because she did not submit the proper transfer paperwork or apply for the job. View "Bisluk v. Hamer" on Justia Law

Within a month after plaintiff-appellant Raymond Zisumbo complained to his supervisor at Ogden Regional Medical Center (ORMC) about alleged race discrimination in the workplace, ORMC investigated Zisumbo for submitting apparently fraudulent letters to his supervisor months earlier. After confirming that at least one of the letters was falsified, ORMC terminated Zisumbo’s employment. Zisumbo sued ORMC for race discrimination and retaliation in violation of Title VII of the Civil Rights Act of 1964, and for breach of the implied duty of good faith and fair dealing under Utah law. After years of litigation, procedural wrangling, and a previous appeal to the Tenth Circuit, only Zisumbo’s Title VII claims for unlawful termination remained to be tried to a jury. The jury found in favor of ORMC on Zisumbo’s discrimination claim but in favor of Zisumbo on his retaliation claim. In cross-appeals and a third parallel appeal, the parties raised numerous issues: Zisumbo challenged the district court’s decisions denying his request to amend his complaint, the granting of summary judgment to ORMC on his good faith and fair dealing claim, and denying in part his request for reinstatement, front pay, and back pay, as well as his request for attorneys’ fees. ORMC appealed the denial of its renewed, post-trial motion for judgment as a matter of law, and the denial of its request to further reduce Zisumbo’s Title VII remedies. Munroe was an English teacher, generally considered to be effective and competent. The District granted Munroe tenure in 2010. In 2009, Munroe began a blog, using the name “Natalie M.” She did not expressly identify where she worked or lived, the name of the school or the names of her students. According to Munroe, her blog was meant to be viewed by friends that she had asked to subscribe. There were fewer than 10 subscribed readers, but no password was required for access. Most of the blog posts were unrelated to her school or work. Some postings included complaints about students, her working conditions, and related matters. The District administration first learned of Munroe’s blog in February 2011 when a reporter from a local newspaper began to ask questions; students apparently were commenting on social media.” Munroe was placed on paid suspension and, later, fired. The District had no regulation specifically prohibiting a teacher from blogging on his or her own time. The Third Circuit affirmed dismissal of Munroe’s 42 U.S.C. 1983 suit; under the Pickering balancing test, Munroe’s speech, in both effect and tone, was sufficiently disruptive so as to diminish any legitimate interest in its expression, and did not rise to the level of constitutionally protected expression.
