Lauderdale v. Illinois Department of Human Services
Marybeth Lauderdale served as acting superintendent and superintendent for the Illinois School for the Deaf (ISD), 2006-2010. During her last year as superintendent, she was paid a total of $88,048. Reggie Clinton was superintendent for the School for the Visually Impaired (ISVI), 1998-2003 and again, 2008-2010. When Clinton returned to ISVI in 2008, he received a 1.9% salary increase from his most recent salary at the Arcola School District. He was paid, at the end of his tenure at ISVI, $121,116 per year. After Clinton resigned, the Illinois Department of Human Services, which oversees ISD and ISVI, created one combined superintendent role to cover both schools and offered Lauderdale the role. Lauderdale wanted to be paid as much or more than Clinton had been paid but eventually accepted a salary of $106,500. Lauderdale sued, alleging sex discrimination under the Equal Pay Act, Title VII of the Civil Rights Act of 1964, and 42 U.S.C. 1983. The district court concluded no reasonable juror could find the pay discrepancy was a product of sex discrimination and that the discrepancy resulted from budget concerns and from the application of the Illinois Pay Plan. The Seventh Circuit affirmed, agreeing that the record indicated that the pay discrepancy was not based on sex. View "Lauderdale v. Illinois Department of Human Services" on Justia Law
Santa Clara Waste Water Co. v. County of Ventura Environmental Health Division
Plaintiff filed suit asserting its right to an administrative hearing to determine whether its chemicals constitute hazardous waste. The Court of Appeal reversed the trial court's denial of the divisions' anti-SLAPP motion to strike the petition and complaint. The court held that the division made a prima facie showing that plaintiff's cause of action arose from an act in furtherance of its right of free speech in connection with a public issue. In this case, plaintiff claimed that the division's decision and notice that Petromax was hazardous waste, by themselves, were causing plaintiff harm even without an enforcement action. State ex rel. Womack v. Sloan
The Supreme Court affirmed the judgment of the court of appeals dismissing the petition of Appellant for a writ of habeas corpus. Appellant was granted parole on the condition of “zero tolerance for any positive drug test.” The next month, he tested positive for drug use. After a revocation hearing, Appellant was reincarcerated. Appellant filed a petition for a writ of habeas corpus, claiming violations of his due process, equal protection, and confrontation rights. The court of appeals concluded that habeas corpus was not available to grant the relief Defendant sought. Shahbazian v. City of Rancho Palos Verdes
Plaintiffs filed suit alleging that the City violated certain ordinances and selectively applied others in issuing the permit for a fence separating two neighbors while denying plaintiffs' permit for a deck they had built. The City filed a special motion to strike under Code of Civil Procedure 425.16 (the anti-SLAPP statute), because plaintiffs' complaint targeted "protected speech" where the City's decisions followed official government proceedings. The Court of Appeal affirmed the trial court's denial of the special motion, holding that section 425.16 does not protect a governmental entity's decisions to issue or deny permits. The court agreed with the trial court that granting a special motion to strike in these circumstances would chill citizens' attempts to challenge government action. View "Shahbazian v. Justiniano v. Social Security Administration
The First Circuit affirmed the district court’s dismissal of Plaintiffs’ suit challenging the Social Security Administration’s (SSA) termination of tier disability benefits for lack of subject matter jurisdiction based on Plaintiffs’ failure to have exhausted their administrative remedies.After the SSA terminated the disability benefits that Plaintiffs had been receiving, Plaintiffs challenged that decision administratively. Before they had exhausted the administrative review process, however, Plaintiffs filed suit in federal court seeking various kinds of relief based presumably on the same grounds as the claims that had presented to the SSA in seeking to continue to receive their benefits. The district court granted the government’s motion to dismiss for lack of subject matter jurisdiction, concluding that Plaintiffs failed to exhaust their administrative remedies. The First Circuit affirmed, holding that Plaintiffs failed to show that they could not obtain a restoration of their benefits through the administrative review process, despite evidence suggesting that they would have a substantial chance of doing so. Whitehall v. County of San Bernardino
Plaintiff Mary Anna Whitehall worked as a social worker for the San Bernardino County Children and Family Services (CFS or the County). She sought legal advice pertaining to any liability she might have for submitting misleading information and doctored photographs to the juvenile court at the direction of her superiors. Her counsel prepared a filing; subsequently plaintiff was immediately placed on administrative leave for disclosing confidential information to an unauthorized person. Upon being informed she would be terminated for the breach, plaintiff resigned her position and filed a whistle blower action against the County. The County filed a special motion to strike the complaint as an Anti-SLAPP action, pursuant to Code of Civil Procedure section 425.16, which was denied by the trial court. The County appealed. On appeal, the County argued the trial court erred in determining plaintiff had established the second prong of the criteria to overcome a special motion to strike an Anti-SLAPP lawsuit by finding a likelihood she would prevail because the County’s actions were not privileged or covered by governmental immunity. Straub v. Reed
The Supreme Court affirmed the order of the circuit court upholding the decision of the Office of Administrative Hearings (OAH) affirming the order of the West Virginia Division of Motor Vehicles (DMV) revoking Petitioner’s driver’s license, despite a nearly two-year delay between Petitioner’s arrest for driving under the influence of alcohol (DUI) and the license revocation. On appeal, Petitioner argued that the procedural delays were so unreasonably excessive that they violated his constitutional rights to due process. The Supreme Court disagreed, holding that the circuit court correctly found that Petitioner demonstrated no prejudice by either the delay of the DMV in issuing the revocation order or the delay in the OAH’s issuing its final order. Pyle v. Woods
Defendant James Woods, a detective in the Cottonwood Heights Police Department, was informed by Utah’s Unified Fire Authority (“UFA”) that medications, including opioids and sedatives, were missing from several UFA ambulances. Detective Woods accessed a state database and searched the prescription drug records of 480 UFA employees in an effort to “develop suspect leads of those who have the appearance of Opioid dependencies.” Consistent with Utah law at the time, Woods did not obtain a search warrant before accessing the Database. Based on the information Woods obtained from the Database search, he developed suspicions about Plaintiffs Ryan Pyle and Marlon Jones. Neither Plaintiff, however, was ever prosecuted for the thefts from the ambulances. Plaintiffs brought separate lawsuits pursuant to 42 U.S.C. 1983, each challenging Defendants’ conduct as violative of the Fourth Amendment and the Fair Credit Reporting Act (“FCRA”). In both suits, the district court dismissed the claims against Defendant Woods, concluding Woods was entitled to qualified immunity because the law governing warrantless access to prescription drug information by law enforcement was not clearly established. The district court also dismissed the FCRA claims because Defendants’ actions fit within an exemption set out in the Act. In Jones’s suit, the district court dismissed the constitutional claims against the city of Cottonwood Heights with prejudice because Jones’s complaint failed to state a claim for municipal liability plausible on its face. In Pyle’s suit, the district court dismissed the constitutional claims against Cottonwood Heights without prejudice, concluding Pyle failed to notify the Utah Attorney General of those claims as required by Rule 5.1 of the Federal Rules of Civil Procedure. Pyle and Jones each appealed. Exercising jurisdiction pursuant to 28 U.S.C. 1291, and finding no reversible error, the Tenth Circuit Court of Appeals affirmed the district court’s judgments. Board of Commissioners of City of Danville v. Advocate Communications, Inc.
The Board of Commissioners of the City of Danville impermissibly went into closed session to discuss its intention to bid on real property offered for sale pursuant to an absolute auction, but the Board’s action was not willful.The Attorney General issued a decision that the Board had violated the Open Meetings Act and that the Board had committed a violation in failing to respond to a written complaint delivered to the mayor by the Danville Advocate-Messenger regarding the Board's closed meeting. The circuit court upheld the Attorney General’s determination but denied the newspaper’s request for attorneys’ fees and costs on grounds that the violations were not willful. The Court of Appeals upheld the finding of an open meeting violation but reversed the trial court’s finding that the violation was not willful. The Supreme Court affirmed in part and vacated in part, holding (1) no exception permitted the Board’s contested action; but (2) the Board’s action was not willful, and therefore, the trial court did not abuse its discretion in denying the newspaper’s motion for costs and fees.
