U.S. Border Patrol Agent Mesa, standing on U.S. soil shot and killed Hernández, a 15-year-old Mexican national, who was on Mexican soil, after having run back across the border after entry onto U.S. territory. Mesa contends that Hernández was part of an illegal border crossing attempt. Hernández’s parents claim he was playing a game with his friends that involved running across the culvert. The Department of Justice concluded that Mesa had not violated Customs and Border Patrol policy or training, and declined to bring charges. The government denied Mexico’s request for Mesa to be extradited. Hernández’s parents sought damages under "Bivens," alleging that Mesa violated Hernández’s Fourth and Fifth Amendment rights. The Fifth Circuit affirmed the dismissal of the suit. On remand from the Supreme Court for reconsideration in light of "Ziglar," the Fifth Circuit again affirmed.The Supreme Court affirmed. Bivens does not extend to claims based on a cross-border shooting. Its expansion to recognize causes of action not expressly created by Congress is “a disfavored’ judicial activity.” While Hernández’s Bivens claims are based on the same constitutional provisions as claims in cases in which damages remedies have been recognized, the context—a cross-border shooting—is significantly different and involves a “risk of disruptive intrusion by the Judiciary into the functioning of other branches.” The Court noted that foreign relations are “so exclusively entrusted to the political branches . . . as to be largely immune from judicial inquiry” and noted the risk of undermining border security. Congress has repeatedly declined to authorize the award of damages against federal officials for injury inflicted outside U. S. borders. When Congress has provided compensation for such injuries, it has done so by empowering Executive Branch officials to make payments under appropriate circumstances. View "Hernandez v. Plaintiffs' challenges to HHS's 2019 Final Rule, implementing Title X of the Public Health Service Act, failed in light of Supreme Court approval of the 1988 regulations and the Ninth Circuit's broad deference to agencies' interpretations of the statutes they are charged with implementing. Section 1008 of Title X prohibits grant funds from being used in programs where abortion is a method of family planning. Specifically, plaintiffs challenged the "gag" rule on abortion counseling, where a counselor providing nondirective pregnancy counseling "may discuss abortion" so long as "the counselor neither refers for, nor encourages, abortion." The Final Rule also requires providers to physically and financially separate any abortion services from all other health care services.The panel held that the Final Rule is a reasonable interpretation of Section 1008; it does not conflict with the 1996 appropriations rider or other aspects of Title X; and its implementation of the limits on what Title X funds can support does not implicate the restrictions found in Section 1554 of the Patient Protection and Affordable Care Act (ACA). The panel also held that the Final Rule is not arbitrary and capricious because HHS properly examined the relevant considerations and gave reasonable explanations; because plaintiffs will not prevail on the merits of their legal claims, they are not entitled to the extraordinary remedy of preliminary injunction; and thus the district courts' preliminary injunction orders are vacated and the cases are remanded for further proceedings. Relying on an earlier decision (Rabun County), the Eleventh Circuit affirmed a decision ordering the removal of a 34-foot Latin cross from the City of Pensacola’s Bayview Park, finding that the maintenance of the cross violated the First Amendment’s Establishment Clause. While the city's petition for certiorari was pending, the Supreme Court held, in "American Legion," that a 32-foot Latin cross on public land in Bladensburg, Maryland does not violate the Establishment Clause. The Supreme Court vacated the earlier decision and remanded for further consideration in light of American Legion.On remand, the Eleventh Circuit concluded that it remains bound by Rabun to conclude that plaintiffs have Article III standing to challenge Pensacola’s maintenance of the cross but that American Legion abrogates Rabun to the extent that the latter disregarded evidence of “historical acceptance.” When "American Legion" is applied, the cross’s presence on city property does not violate the Establishment Clause. The Bayview cross (in one iteration or another) stood in the same location for more than 75 years; there is no evidence of the city's original purpose in its placement. Jackson served in the Marine Corps, 1977-1991. Almost 30 years after his honorable discharge, Jackson filed a pro se complaint alleging that toward the end of his military career, his supervising officers discriminated against him because he is a black male, in violation of Title VII of the Civil Rights Act of 1964, 42 U.S.C. 2000e. The district court inferred additional claims under the Administrative Procedure Act (APA), 5 U.S.C. 706(2)(A), and the Military Pay Act, 37 U.S.C. 204 but ultimately dismissed all of Jackson’s claims. The D.C. Circuit affirmed. The court noted the unanimous rulings of other sister circuits, concluding that Title VII does not apply to uniformed members of the armed forces. Jackson’s APA claim was untimely and, although the limitations period is no longer considered jurisdictional, the facts alleged were insufficient to apply equitable tolling. Jackson was able to manage his affairs and comprehend his rights; he alleged that at the time of the alleged discrimination, he knew that he “had been subjected to wrongdoing and strongly desired justice.” The court concluded that it lacked jurisdiction to review the dismissal of Jackson’s Military Pay Act claim; the Court of Appeals for the Federal Circuit has exclusive jurisdiction of such claims. Brome started with the California Highway Patrol in 1996; he transferred offices twice. Other officers subjected Brome, who was openly gay, to derogatory comments; singled him out for pranks; and refused to provide him with backup assistance. Brome filed administrative complaints, including with the Department of Fair Employment and Housing. The incidents continued. Brome won the Solano Area Officer of the Year Award in 2013, but the Patrol never displayed his photograph, in a break from office practice. Through 2014, Brome complained to his superiors. The problems continued and Brome feared for his life during enforcement stops, experienced headaches, muscle pain, stomach issues, anxiety, and stress, and became suicidal. Brome went on medical leave and filed a successful workers’ compensation claim. He took industrial disability retirement.The court dismissed his claims under the California Fair Employment and Housing Act (Gov. Code 12900), as untimely, rejecting Brome’s claim that he was constructively discharged. The court of appeal reversed. The filing of the workers’ compensation claim could equitably toll the one-year deadline for filing his discrimination claim; equitable tolling would not prejudice the Patrol. After years of harassment, Brome was struggling to recover; although 11 months elapsed, Brome can meet the good faith requirement. While it is not the only possible conclusion, there is enough evidence for a reasonable trier of fact to conclude that the Patrol knowingly permitted the conditions and should have known that a reasonable employee would resign. Elston and his friends were playing basketball at a DuPage County park, heckling one another with salty language. Demeter, an off-duty Kane County sheriff’s deputy, watching his child’s soccer game, demanded that they stop using expletives. Demeter flashed his badge and gun. The boys refused to clean up their language. Demeter grabbed Elston by the neck, threw him to the ground, and climbed on top of him. Bystanders separated the two. Demeter called 911, identifying himself as a police officer in need of assistance. Demeter told Elston’s father that he was a police officer attempting to take Elston into custody for disorderly conduct. Elston was never charged with any offense. Demeter pleaded guilty to violating Aurora’s ordinance against battery.Elston sued Demeter under 42 U.S.C. 1983, winning a default judgment and an award of $110,000. Elston also sued Kane County under Illinois’s Tort Immunity Act. The district court rejected the suit on summary judgment. The Seventh Circuit affirmed. Demeter was acting as a private citizen, not within the scope of his duties as a deputy when he injured Elston. Demeter was not acting substantially within the time and space limits authorized by his employment; that Demeter used his badge, gun, and training in an unauthorized manner in q purely personal pursuit does not bring his conduct within the scope of his employment. The First Amendment does not create an implied damages action against officials in the Office of the Comptroller of the Currency (OCC) for retaliatory administrative enforcement actions under the Financial Institutions Reform, Recovery, and Enforcement Act of 1989 (FIRREA). The DC Circuit held that, consistent with the Supreme Court's marked reluctance to extend Bivens v. Six Unknown Named Agents of Federal Bureau of Narcotics, 403 U.S. 388 (1971), to new contexts, the First Amendment does not create such an implied damages action.In this case, plaintiff filed suit against the United States and four OCC officials, alleging Bivens claims against the officials as well as various tort claims. The Bivens claims were based on the theory that the officials caused the OCC enforcement action in retaliation for plaintiff's protected speech criticizing an OCC investigation, in violation of the First and Fifth Amendments of the Constitution. The court held that this case clearly presented a new Bivens context, and FIRREA's administrative enforcement scheme is a special factor counselling hesitation. Therefore, the court reversed the district court's judgment and remanded with instructions to dismiss plaintiff's First Amendment claims. View "Loumiet v. United States" on Justia Law

Planned Parenthood filed suit against HHS, alleging that the agency's 2018 Funding Opportunity Announcements (FOAs) for funding programs to combat teen pregnancy were contrary to the law as required in their appropriation, the Teen Pregnancy Prevention Program (TPPP), which is the relevant part of the 2018 Consolidated Appropriations Act.The Ninth Circuit reversed the district court's dismissal of the action, holding that Planned Parenthood had standing under the competitor standing doctrine and that the case is not moot because it satisfies the capable of repetition, yet evading review exception to mootness. The panel explained that Planned Parenthood could reasonably expect to be subject to the same injury again, and the injury was inherently shorter than the normal life of litigation.The panel exercised its discretion to reach two issues in the first instance. First, the panel held that the 2018 Tier 1 FOA was contrary to law, because the 2018 Tier 1 FOA's direction that grant applicants address and replicate each of the elements of the TAC or the SMARTool, contradicts the TPPP's direction that Tier 1 grants go only to applicants whose programs are proven effective. Second, the panel held that the 2018 Tier 2 FOA was not contrary to the TPPP on its face. The panel remanded the case to the district court for further proceedings. Johnson rented her restaurant to a private party. For unknown reasons, individuals unaffiliated with her or the party emerged from a vehicle that night and shot at the restaurant. Police were called during the shooting but never apprehended the shooters. Less than two days later, Saginaw City Manager Morales issued Johnson a notice ordering the suspension of all business activity related to her restaurant under an ordinance that permits such suspensions “in the interest of the public health, morals, safety, or welfare[.]” There was hearing three days later. More than two months after the hearing, Human Resources Director Jordan upheld the suspension. Johnson filed suit with a motion for a temporary restraining order and, alternatively, a motion for a preliminary injunction to prevent Morales from sitting on the appeal panel expected to review Jordan’s decision. The district court denied that motion. The appeal panel, which did not include Morales, held a hearing and affirmed Jordan’s decision upholding the suspension. The Sixth Circuit reversed, in part, the dismissal of Johnson’s burden-shifting, substantive due process, and equal-protection claims. Johnson adequately alleged selective enforcement and pled that the city lacked a rational basis to suspend her license. Plaintiff and the Association filed suit under Title II of the Americans with Disabilities Act and Section 504 of the Rehabilitation Act against several Florida entities and officials, challenging defendants' failure to provide captioning for live and archived videos of Florida legislative proceedings.The Eleventh Circuit affirmed the district court's ruling that Congress validly abrogated defendants' Eleventh Amendment immunity for the claims under Title II regardless of whether the right is "fundamental." The court agreed with the district court's holding that Congress validly abrogated defendants' Eleventh Amendment immunity because a fundamental right was at stake and, in the alternative, Congress validly abrogated defendants' Eleventh Amendment immunity even if a fundamental right was not at stake. Furthermore, Congress's identification of discrimination in public services and voting establishes the necessary history of discrimination for the rights implicated here: access to public legislative information relevant to voting, and Title II is an appropriate response to this history and pattern of unequal treatment.The court also affirmed the district court's holding that plaintiffs were entitled to pursue declaratory and injunctive relief against state officials under the doctrine of Ex parte Young for allegedly ongoing violations of Title II. Finally, the court held that the district court did not abuse is discretion in ordering discovery prior to resolving the question of sovereign immunity. View "National Association of the Deaf v.
