PSBA is a non-profit association created by Pennsylvania’s school districts. Campbell energetically used Pennsylvania's Right to Know Law (RTKL) to obtain records from PSBA’s constituent school districts. In 2017, Campell sent RTKL requests to public school agencies, seeking contact information for district employees and union representatives. PSBA’s attorney advised member districts that they were required to release publicly-available information, but they did not have to provide private data and that they could simply make the results “available for pickup.” When Campbell received copies of PSBA’s legal guidance, he established a web page entitled “PSBA Horror,” mocking PSBA's Executive Director. PSBA’s counsel threatened to sue Campbell for defamation. Campbell submitted another, 17-page, RTKL request, seeking 27 types of documentation regarding the districts' relationship with PSBA.PSBA sued Campbell, alleging defamation, tortious interference with contractual relations, and abuse of process. Campbell then filed a 42 U.S.C. 1983 suit, alleging that PSBA’s state suit was motivated by an improper desire to retaliate against him for proper RTKL requests, violating his First Amendment rights. The Third Circuit affirmed the dismissal of Campell’s suit. Campbell’s RTKL requests and PSBA’s state tort claims were both protected under the Noerr-Pennington doctrine, which shields constitutionally-protected conduct from civil liability, absent certain exceptions. The district court erred in requiring a heightened burden of proof on PSBA’s motives in bringing its state court tort claims but Campbell’s civil rights claim would fail under any standard of proof. After the Department discharged plaintiff based on her failure to report another deputy's use of force against an inmate and her failure to seek medical assistance for the inmate, the Commission affirmed the discharge. However, the trial court granted plaintiff's petition for writ of mandate and directed the Commission to set aside plaintiff's discharge, award her back pay, and reconsider a lesser penalty.The Court of Appeal reversed and remanded, holding that the Commission did not abuse its discretion in upholding plaintiff's discharge. In this case, plaintiff committed a more egregious violation of Department policy that went beyond a failure to report the use of force or to seek medical attention by perpetuating a code of silence among deputies in the jail, which encouraged other deputies to ignore their responsibilities and brought embarrassment to the Department. Therefore, plaintiff's conduct also violated the general behavior policy, which requires a deputy "not act or behave privately or officially in such a manner as to bring discredit upon himself or the Department." Given the Department's reasoned explanation that discharge was necessary in light of plaintiff's furtherance of the code of silence and the resulting embarrassment and loss of trust in the Department, the court held that this is not the exceptional case where reasonable minds cannot differ on the appropriate penalty. Jane Doe appealed the dismissal of her Title IX claim against School District No. 1, Denver, Colorado (the District or DPS) for failure to state a claim. According to the complaint, a group of students began sexually harassing Ms. Doe after she was sexually assaulted by another student in March of her freshman year at East High School (EHS). She alleged that despite her numerous reports of the harassment to school personnel, as well as reports from teachers and a counselor, the school administration never investigated her complaints and little if anything was done to prevent the harassment from continuing. She stopped attending regularly scheduled classes about 14 months after the assault, and she transferred to a different school after completing her sophomore year. The Tenth Circuit reversed and remanded, finding Ms. Doe's complaint contained sufficient allegations to support an inference of deliberate indifference. View "Doe v. The Fourth Circuit vacated the district court's order denying Proposed Intervenors' renewed motion to intervene in an action brought by the NAACP challenging the validity of Senate Bill 824. S.B. 824 established, inter alia, photographic voter identification requirements for elections in North Carolina.After determining that it has jurisdiction under 28 U.S.C. 1291, the court held that the Proposed Intervenors have Article III standing to intervene for the purposes of intervention before the district court based on N.C. Gen Stat. 1-72.2 and Supreme Court precedent. The court rejected the arguments of the NAACP and the State Defendants that section 1-72.2 infringes on the powers of the Executive Branch in violation of the North Carolina Constitution's separation of powers provisions.In regard to intervention as a matter of right, the court held that the district court erred in determining that the Proposed Intervenors lacked a sufficient interest in the S.B. 824 litigation without careful consideration of section 1-72.2(a). Therefore, the court remanded for the district court to more fully consider the North Carolina statute in the analysis of the Proposed Intervenors' interest in the litigation. Because the Proposed Intervenors may have interests which may be practically impaired if not permitted to intervene in the action before the district court, the court remanded as to this issue as well. The court further stated that, although it was appropriate for the district court to apply the Westinghouse presumption since the Proposed Intervenors and the State Defendants appear to seek the same ultimate objective, the district court erred in demanding that the Proposed Intervenors overcome that presumption by the heightened standard of a "strong showing." In regard to permissive intervention, the court held that the district court failed to address sections 1-72.2(a) and (b) and 120-32.6. Plaintiffs filed suit challenging the quarantine decisions of certain Connecticut state officials in response to an Ebola epidemic in West Africa. On appeal, plaintiffs challenged the district court's denial of their motion for class certification and dismissing their suit for lack of standing and based on qualified immunity. Plaintiffs primarily argue that they suffered actual or imminent injuries that create standing to seek prospective relief to avert allegedly unconstitutional future quarantines; clearly established law required that any quarantine imposed be medically necessary and comport with certain procedural safeguards; and their class is sufficiently numerous to merit certification.The Second Circuit affirmed and held that the district court properly deemed plaintiffs' injuries too speculative to support standing. In this case, plaintiffs failed to plead a sufficient likelihood that, under the revised policy, any of them faces a substantial risk of suffering a future injury. The court also held that the law surrounding quarantines was not clearly established such that a state official may be held liable for the actions taken here. The court did not reach the class certification issue because it is mooted by the court's conclusion as to standing. Accordingly, the court remanded with instructions to amend the judgment to clarify that the state law claims were dismissed without prejudice. View "Liberian Community Ass'n v. Lamont" on Justia Law

Daisy Arias suffered sustained, egregious sexual harassment for most of the time she was employed by defendant-petitioner, Blue Fountain Pools & Spas, Inc. The primary culprit was defendant-petitioner, Sean Lagrave, a salesman who worked in the same office as Arias. Arias says Lagrave did everything from repeatedly asking her for dates to grabbing her and describing "his own sexual prowess." Arias complained about Lagrave’s conduct repeatedly over the course of her employment, but things came to a head on April 21, 2017: Lagrave yelled at Arias in front of coworkers, used gender slurs, and then physically assaulted her, bumping her chest with his own. Arias called the police and later left work. Arias told the owner, defendant-petitioner, Farhad Farhadian, she wasn’t comfortable returning to work with Lagrave. Farhadian did nothing initially, refused to remove Lagrave, then terminated Arias’s health insurance, and finally told Arias to pick up her final paycheck. Though Farhadian claimed Arias had quit, she says she was fired. Arias filed a complaint with the Department of Fair Employment and Housing and received a right to sue letter on August 14, 2017. She then filed this lawsuit alleging, relevant to this appeal, hostile work environment sex discrimination and failure to prevent sexual harassment. Petitioners moved for summary judgment, seeking, among other things, to have the hostile work environment claim dismissed as time-barred and the failure to prevent harassment claim dismissed as having an insufficient basis after limiting the allegations to the conduct that wasn’t time-barred. The trial court concluded Arias had created a genuine issue of material fact as to all her causes of action and denied the motion. Petitioners brought a petition for writ of mandate, renewing their statute of limitations argument, claiming Arias could not establish a continuing violation because she admitted she had concluded further complaints were futile. The Court of Appeal concluded Arias has shown she could establish a continuing violation with respect to all the complained of conduct that occurred during Farhadian’s ownership of the company. Further, the Court determined there was a factual dispute over whether and when Arias’s employer made clear no action would be taken and whether a reasonable employee would have concluded complaining more was futile: "that question must be resolved by a jury." While in office, Courser, a former Republican member of the Michigan House of Representatives, had an affair with another representative, Gamrat. The defendants were legislative aides assigned to Courser and Gamrat. Worried that he and Gamrat eventually would be caught, Courser concocted a plan to get ahead of the story by sending out an anonymous email to his constituents accusing himself of having an affair with Gamrat, but including outlandish allegations intended to make the story too hard to believe. Courser unsuccessfully attempted to involve one of the defendants in the “controlled burn.” The defendants reported Courser’s affair and misuse of their time for political and personal tasks to higher-ups. In retaliation, Courser directed the House Business Office to them. After they were fired, the defendants unsuccessfully tried to expose the affair to Republican leaders, then went to the Detroit News. Courser resigned and pleaded no contest to willful neglect of duty by a public officer.Courser later sued, alleging that the defendants conspired together and with the Michigan House of Representatives to remove him from office. The Sixth Circuit affirmed the dismissal of all of Courser’s claims: 42 U.S.C. 1983 and 1985; violation of the Fair and Just Treatment Clause of the Michigan Constitution; computer fraud; libel, slander, and defamation; civil stalking; tortious interference with business relationships; negligence and negligent infliction of emotional distress; RICO and RICO conspiracy; intentional interference with or destruction of evidence/spoliation; and conspiracy. The Randolph-Sheppard Act, 20 U.S.C. 107, requires government agencies to set aside certain contracts for sight-challenged vendors. States license the vendors and match them with available contracts. In 2010, Michigan denied Armstrong’s bid for a contract to stock vending machines at highway rest stops. A state ALJ ruled in Armstrong’s favor and recommended that she get priority for the next available facility/location. The state awarded Armstrong an available vending route later that year. Armstrong nonetheless requested federal arbitration, seeking nearly $250,000 in damages to account for delays in getting the license. The arbitrators ruled that Armstrong was wrongfully denied the location she sought and ordered Michigan to immediately assign Armstrong the Grayling vending route but declined to award damages, reasoning that her request was “too speculative.”The district court upheld the arbitration award and rejected Armstrong’s 42 U.S.C. 1983 claims, concluding that the Randolph-Sheppard Act created the sole statutory right to relief under federal law. Michigan subsequently granted her the Grayling license. The Sixth Circuit affirmed. The unfavorable arbitration decision was not arbitrary or capricious under the Administrative Procedure Act. The United States District Court for the District of Idaho certified a question of law to the Idaho Supreme Court. Plaintiff was a prisoner in the custody of the Idaho Department of Correction (IDOC), currently incarcerated at the Idaho State Correctional Institution (ISCI). He asserts that he, and all IDOC prisoners, have a state-created liberty interest in being employed, arising from Idaho Code [section] 20-209. Plaintiff asserted the statute contained a "very specific, clear, and unambiguous" mandate that the Board of Correction must provide all inmates with employment during incarceration. The federal court asked the Idaho Supreme Court for guidance on plaintiff's contention: whether Idaho Code section 20-209 required the state board of correction to provide employment for all prisoners, and, if so, what was the minimum the board must do to implement the statute’s mandate? The Supreme Court responded, finding 20-209 required the Board to make employment available for all prisoners in the form of: (1) labor assignments as prescribed by the Board’s rules and regulations; and/or (2) implementation of statutory work programs managed by the Board in accordance with its rules and regulations. The Board retained discretion to manage these prisoner employment opportunities pursuant to its broad control over the correctional system. Section 20-209 did not create a right to paid or unpaid work during a prisoner’s period of incarceration or establish an employer-employee relationship between the Board and the prisoner. At a minimum, the Board must comply with legislation controlling its responsibilities managing prisoner employment and with its own rules and regulations. Two counties sued Sherwin-Williams in state court, seeking abatement of the public nuisance caused by lead-based paint. Anticipating suits by other counties, Sherwin-Williams sued in federal court under 42 U.S.C. 1983. Sherwin-Williams claimed that “[i]t is likely that the fee agreement between [Delaware County] and the outside trial lawyers [is] or will be substantively similar to an agreement struck by the same attorneys and Lehigh County to pursue what appears to be identical litigation” and that “the Count[y] ha[s] effectively and impermissibly delegated [its] exercise of police power to the private trial attorneys” by vesting the prosecutorial function in someone who has a financial interest in using the government’s police power to hold a defendant liable. The complaint pleaded a First Amendment violation, citing the company’s membership in trade associations, Sherwin-Williams’ purported petitioning of federal, state, and local governments, and its commercial speech. The complaint also argued that the public nuisance theory would seek to impose liability “that is grossly disproportionate,” arbitrary, retroactive, vague, and “after an unexplainable, prejudicial, and extraordinarily long delay, in violation of the Due Process Clause.”The Third Circuit affirmed the dismissal of the suit. Sherwin-Williams failed to plead an injury in fact or a ripe case or controversy because the alleged harms hinged on the County actually filing suit. View "Sherwin Williams Co. v.
