Plaintiff, his three children, and Stop Child Protection Services from Legally Kidnapping filed suit against the county, DCSS, nine county officials, and three officials. Plaintiffs' constitutional, federal, and state law claims stemmed from a Child in Need of Protection of Services (CHIPS) proceeding by DCSS.The Eighth Circuit affirmed the district court's grant of defendants' motion to dismiss, holding that plaintiffs lacked standing to challenge the facial constitutionality of three Minnesota child welfare statutes; plaintiff was not entitled to monetary damages under 42 U.S.C. 1983, because he failed to establish a due process violation, an equal protection claim, and municipal liability and conspiracy; and the children are also not entitled to damages under section 1983. The court also held that, even if the complaint was sufficiently pled and established a constitutional violation, defendants would be entitled to qualified immunity. Furthermore, the court held that no conduct by the individual defendants, as alleged in the amended complaint, rose to the level of maliciousness required to deny official immunity under Minnesota law. The Michigan Department of Health and Human Services contracts out most of its fostering and adoption services to private child-placing agencies (CPAs), which perform home evaluations of prospective adoptive and foster parent(s). One CPA, St. Vincent Catholic Charities, shares the religious teachings of the Roman Catholic Church regarding same-sex marriage. It “cannot provide a written recommendation ... endorsing a family situation that would conflict with [its] religious beliefs” so St. Vincent refers out home evaluations for same-sex or unmarried couples to other CPAs. In 2015, Michigan codified this practice. M.C.L. 722.124e(1)(g) provides that “[t]o the fullest extent permitted by state and federal law," a CPA shall not be required to provide any services if those services conflict with, or provide any services under circumstances that conflict with," the CPA’s "sincerely held religious beliefs.”The Dumonts alleged that they were a same-sex couple interested in fostering and adoption, but that St. Vincent refused to assist them with the licensing process because of their sexual orientation. Michigan settled that suit by agreeing to enforce, against CPAs, a policy prohibiting discrimination on the basis of sexual orientation. St. Vincent then claimed that the state violated its First and Fourteenth Amendment rights by directing it to perform its duties in a manner that violates its sincerely held religious beliefs. The district court denied the Dumonts’ motions, seeking intervention. The Sixth Circuit reversed with respect to permissive intervention. Citing FRCP 24(b)(3), the court held that the Dumonts’ motion was timely, that it presented a common question of law, and that there is little risk of undue delay or prejudice to the existing parties. Plaintiff filed suit against George Washington University, alleging that it violated the Americans with Disabilities Act (ADA) by failing to provide a reasonable accommodation and discriminating against her because of her illness. Plaintiff also alleged retaliation and interference claims under the Family Medical Leave Act (FMLA). Less than a year after plaintiff underwent treatment for cancer while working as a psychiatry resident at the George Washington University Hospital, she was terminated based on documented instances of unprofessionalism and deficient performance.The DC Circuit affirmed the district court's grant of summary judgment in favor of the University on all claims. The court held that plaintiff failed to request an accommodation under the ADA, choosing to seek leave under the FMLA. Furthermore, plaintiff failed to identify evidence allowing a reasonable jury to conclude that her employer discriminated against her because of her disability. The court also held that plaintiff failed to rebut the University's legitimate justifications for its actions. Therefore, plaintiff's interference and retaliation claims under the FMLA likewise failed. View "Waggel v. George Washington University" on Justia Law

The Supreme Judicial Court vacated certain portions of a trial judge's nondisparagement orders issued to the parties in this case in an attempt to protect the psychological well-being of the parties' minor child, holding that the nondisparagement orders here operated as an impermissible prior restraint on speech.After Mother filed for divorce from Father, Mother filed a motion for temporary orders, including a request that the judge prohibit Father from posting disparaging remarks about her and the ongoing litigation on social media. The judge issued temporary orders that included nondisparagement provisions against both parties. Thereafter, Mother filed a complaint for civil contempt alleging that Father violated the first order. A different judge declined to find contempt on the ground that the first order, as issued, constituted an unlawful prior restraint of speech in violation of Father's constitutional rights. The Supreme judicial Court agreed, holding that the nondisparagement orders were unconstitutional. View "Shak v. Shak" on Justia Law

The Eleventh Circuit denied a motion for a stay of a preliminary injunction that enjoins certain applications of a public health order issued in response to the COVID-19 pandemic in Alabama. The public health order, published on March 27, 2020, mandated the postponement of all dental, medical, or surgical procedures. Plaintiffs, abortion providers in Alabama, sought a temporary restraining order (TRO) preventing enforcement of the public health order as applied to pre-viability abortions. After the district court issued a TRO, the state filed a motion to dissolve the TRO and included clarifications. The district court subsequently adopted the state's clarifications and issued an April 3rd order, staying the TRO in part. The state later changed its interpretation again. Based on the evidence presented at the preliminary injunction hearing, the district court determined that the medical restrictions, as read pursuant to the state's earlier interpretation, violate the Fourteenth Amendment.The court held that the state has not made a strong showing that it is likely to succeed on the merits of its appeal or that it will be irreparably injured absent a stay. In this case, because of the state's shifting interpretations of the March 27th and April 3rd orders, the district court had ample authority to issue a preliminary injunction to preserve the status quo and prevent the state from reverting to its initial and more restrictive interpretations.The district court considered Jacobson v. Commonwealth of Massachusetts and Smith v. Avino, but read them together with cases holding that the Fourteenth Amendment generally protects a woman's right to terminate her pregnancy. Applying both the Jacobson framework and the Casey undue-burden test together, the district court concluded that the April 3rd order imposed a plain, palpable invasion of rights, yet had no real or substantial relation to the state's goals. The court held that the district court was permitted to reach this conclusion and to issue a status quo preliminary injunction to ensure that the state did not deviate from the Alabama State Health Officer's interpretation of the April 3rd order at the preliminary injunction hearing. Mayle, a self-proclaimed Satanist, is a follower of The Law of Thelema, a set of beliefs developed in the early 1900s by Aleister Crowley. As part of this religion, Mayle participates in what he calls “sex magick rituals” that he believes violate Illinois laws forbidding adultery and fornication. He claims that he reasonably fears prosecution for practicing his beliefs. He also says that he wants to marry more than one person at the same time and that if he were to do so, he would violate an Illinois law against bigamy. Mayle’s first challenge to the laws was dismissed. Mayle did not appeal, but the next year he filed another suit challenging the same statutes.The Seventh Circuit affirmed the dismissal of the second suit, first rejecting a challenge to the district court’s grant of a two-day extension to allow Mayle to file a notice of appeal. Mayle’s bigamy claim was precluded by the 2017 final judgment on the merits. Mayle lacked standing to challenge the state’s adultery and fornication laws because he still showed no reasonable fear of prosecution; those laws are no longer enforced. View "Mayle v. The Fifth Circuit granted a writ of mandamus directing vacatur of the district court's issuance of a temporary restraining order (TRO) against executive order GA-09 as applied to abortion procedures. In order to preserve critical medical resources during the escalating COVID-19 pandemic, the Governor of Texas issued GA-09, which postpones non-essential surgeries and procedures until 11:59 p.m. on April 21, 2020.The court held that the drastic and extraordinary remedy of mandamus was warranted in this case because the district court ignored the framework governing emergency public health measures, like GA-09, in Jacobson v. Commonwealth of Massachusetts, 197 U.S. 11 (1905); the district court wrongly declared GA-09 an "outright ban" on previability abortions and exempted all abortion procedures from its scope, rather than apply the Jacobson framework to decide whether GA-09 lacks a "real or substantial relation" to the public health crisis or whether it is "beyond all question, a plain, palpable invasion" of the right to abortion; the district court failed to apply the undue-burden analysis in Planned Parenthood v. Casey, 505 U.S. 833, 857 (1992), and thus failed to balance GA-09's temporary burdens on abortion against its benefits in thwarting a public health crisis; and the district court usurped the state's authority to craft emergency health measures, substituting instead its own view of the efficacy of applying GA-09 to abortion. Therefore, the court found that the requirements for a writ of mandamus are satisfied in light of the extraordinary nature of these errors, the escalating spread of COVID-19, and the state's critical interest in protecting the public health. A family of two parents and five children alleged that social workers employed by the Kentucky Cabinet for Health and Family Services violated their Fourth Amendment rights by subjecting the children to warrantless in-school interrogations without reasonable suspicion of child abuse. They also claimed violations of their Fourteenth Amendment rights by requiring adherence to a “Prevention Plan,” which constrained the mother’s ability to be alone with her children for approximately two months without any question as to her parental fitness and without any procedural protections.The Sixth Circuit reversed the denial of qualified immunity on the Fourth Amendment claims. The law governing in-school interviews by social workers was not clearly established at the time of the relevant conduct. The Fourth Amendment does govern a social worker’s in-school interview of a child pursuant to a child abuse investigation; at a minimum, a social worker must have a reasonable suspicion of child abuse before conducting an in-school interview when no other exception to the warrant requirement applies. The court affirmed the denial of qualified immunity on the procedural and substantive due process claims. The complaint alleged that the supervision restrictions were imposed for approximately two months after there was no longer any question as to parental fitness without any procedural protections; they abridged the parents’ clearly established right to the companionship and care of their children without arbitrary government interference. The Fifth Circuit affirmed the district court's grant of summary judgment in favor of Shell in an action brought by plaintiff under the Family Medical Leave Act (FMLA) and the Americans with Disabilities Act (ADA). In this case, the day after Shell formally disciplined plaintiff for violating its attendance policy, she missed her scheduled shift because she got arrested for drunk driving and wrecked her truck.The court held that employees cannot immunize themselves from legitimate termination by taking FMLA leave. In regard to plaintiff's FMLA retaliation claim, the court held that Shell produced evidence that plaintiff would have been lawfully terminated had she not taken leave, and thus she had no right to return to work. The court held that plaintiff failed to make a prima facie case under the ADA because she did not present admissible evidence establishing that she was disabled or that Shell regarded her as disabled. Even if plaintiff had made a prima facie case, her argument failed for the same reasons her FMLA retaliation claim failed. View "Amedee v. Shell Chemical, L.P." on Justia Law

The Supreme Court reversed the judgment of the district court terminating Father's parental rights to his two children, holding that Father's due process rights were infringed by ineffective assistance of counsel, and because of counsel's ineffective assistance, Father was prejudiced and his parental rights were terminated.In arguing that he received ineffective assistance of counsel as it related to placement of the children and his stipulation to a treatment plan, Father pointed out that he was the non-offending, non-custodial parent and that there were no allegations of abuse or neglect ever brought in this case against him. Father asserted that but forms counsel's failure to correct legal misunderstandings, failure to object to an unnecessary treatment plan, and failure to request a placement hearing, his parental rights would not have been terminated. The Supreme Court agreed, holding (1) the Montana Department of Health and Human Services, Child and Family Services Division did not prove the existence of good cause to deny immediate placement with Father; and (2) Father's fundamental rights were prejudiced by ineffective assistance of counsel.
