The Mayor of Chicago appoints the city’s Board of Education, 105 ILCS 5/34-3. Until 1995, the Mayor needed the consent of the City Council; now the Mayor acts independently. Plaintiffs claimed that the system violated the Voting Rights Act, 52 U.S.C. 10301 (section 2). School boards elsewhere in Illinois are elected; plaintiffs say that failure to elect the school board in Chicago has a disproportionate effect on minority voters. The Seventh Circuit affirmed the dismissal of the complaint. Section 2(a) covers any “voting qualification or prerequisite to voting or standard” that results in an abridgment of the right to vote; it does not guarantee that any given public office be filled by election rather than appointment, a civil service system, or some other means. Whether having an appointed board is “good government” or good for pupils is irrelevant to the Act. While more minority citizens live in Chicago than in other Illinois cities and do not vote for school board members, neither does anyone else. Plaintiffs submitted a ballot initiative petition proposing to amend the Ohio Constitution by imposing term limits on the justices of the Ohio Supreme Court and requiring that all laws “that apply to the people of the State of Ohio . . . apply equally to the members and employees of the General Assembly.” The single-subject rule, Ohio Rev. Code 3503.062(A), allows initiative petitions to contain only “one proposed law or constitutional amendment,” so the Ohio Ballot Board split the initiative into two initiatives, each containing one proposed constitutional amendment. Plaintiffs challenged the process. Sixth Circuit affirmed the dismissal of the suit, rejecting an argument that the process was a content-based regulation of core political speech. The Supreme Court has not viewed single-subject rules as inconsistent with the First Amendment and the Ohio Supreme Court has rejected an essentially identical challenge. Ohio’s single-subject rule applies to all petitions, regardless of their substantive messages, and may be justified without reference to the content of any initiative petitions. The rule is intended to prevent voter confusion and "logrolling." Whether Plaintiffs violate Ohio’s single-subject rule depends not on what they say, but simply on where they say it; it is a minimally burdensome and nondiscriminatory regulation. Intervening defendants could not be required to pay a portion of prevailing plaintiffs' attorneys fees and costs, awarded under 42 U.S.C. 1988(b) and 52 U.S.C. 10310(e), when intervening defendants were not charged with any wrongdoing and could not be held liable for the relief that plaintiffs sought. In Independent Federation of Flight Attendants v. Zipes, 491 U.S. 754 (1989), the Supreme Court precluded the assessment of attorneys fees and costs against intervenors who were "blameless," meaning that they were not charged as wrongdoers and legal relief could not have been obtained from them. In this racial gerrymandering case, the Fourth Circuit held that Zipes was controlling and that the Commonwealth could not be held liable for attorneys fees and costs incurred by plaintiffs in litigating against the entry of Intervening Congressmen or against Intervening Congressmen's positions. Under the traditional American rule, plaintiffs must bear those intervention-related fees. Accordingly, the court vacated the district court's order awarding attorneys fees and costs, remanding for reconsideration of plaintiffs' petitions for fees. View "Brat v. Citizens United filed suit challenging the regulations promulgated by the Attorney General's office that required non-profit organizations to disclose their donors on a yearly basis. The Second Circuit affirmed the district court's dismissal of all claims, except the due process claim, for failure to state a claim. The court found that the mere requirement on a tax‐exempt organization to disclose its donor list to a state's authority charged with regulating non‐profits did not impermissibly chill speech or assembly rights. Furthermore, it did not operate as a prior restraint on non‐profits' solicitation of donations. Finally, the court reversed the dismissal of the due process claim for lack of ripeness and remanded so that the claim could be dismissed with prejudice for failure to state a valid claim. Plaintiff, a former Austin City Councilmember, filed suit challenging four provisions of Austin's campaign-finance law: a base limit on contributions to candidates; an aggregate limit on contributions from persons outside of the Austin area; a temporal restriction prohibiting all contributions before the six months leading up to an election; and a disgorgement provision requiring candidates to distribute excess campaign funds remaining at the end of an election. The Fifth Circuit affirmed the district court's decision upholding the base limit; holding that plaintiff lacked standing to challenge the aggregate limit because he had not established a sufficient injury-in-fact traceable to that limit; holding that Austin had failed to establish that the six-month temporal limit on fundraising served the interest of preventing actual corruption or its appearance; and holding that plaintiff had standing to challenge the disgorgement provision and the disgorgement provision was unconstitutional. The Uniformed and Overseas Citizens Absentee Voting Act (UOCAVA) requires states to permit "overseas voters" to vote by absentee ballot in federal elections, 52 U.S.C. 20302(a)(1). An “overseas voter” resides outside the U.S. and would otherwise be qualified to vote in the last place in which the person was domiciled in the U.S. Illinois law provides that “[a]ny non‐resident civilian citizen, otherwise qualified to vote," may vote by mail in a federal election. "Non‐resident civilian citizens" reside “outside the territorial limits" of the U.S. but previously maintained a residence in Illinois and are not registered to vote in any other state. Former Illinois residents, now residing in the U.S. territories of Puerto Rico, Guam, and the Virgin Islands, challenged the laws as violating their equal protection rights and their right to travel protected by the Due Process Clause. The territories where the plaintiffs reside are considered part of the U.S. under the statutes, while other territories are not. The district court held that there was a rational basis for the inclusion of some territories but not others in the definition. The Seventh Circuit affirmed with respect to the Illinois statute but concluded that plaintiffs lack standing to challenge the UOCAVA, which does not prevent Illinois from providing the plaintiffs absentee ballots and does not cause their injury. In 2012, minor political parties challenged Pennsylvania’s election laws under the First and Fourteenth Amendment, 42 U.S.C. 1983. Minor parties gather a considerable number of signatures to place candidates on the ballot; the validity of those signatures can be challenged. A successful challenge may result in an award of costs (which may be considerable). The threat of these high costs has deterred some candidates. The court held that the statutes were, in combination, unconstitutional as applied to the parties, and ultimately adopted the Commonwealth’s proposal, based on a pending Pennsylvania General Assembly bill, that minor party candidates be placed on the ballot if they gather two and one-half times as many signatures as major party candidates must gather for the office of Governor, at least 5,000 signatures must be gathered with at least 250 from at least 10 of the 67 counties. For other statewide offices, the bill required 1,250-2,500 signatures with at least 250 from at least five counties. The court did not find any facts, nor explain its decision. The Third Circuit vacated, finding the record inadequate to support the signature gathering requirement. The appropriate inquiry is concerned with the extent to which a challenged regulation actually burdens constitutional rights and is “fact-intensive.” The court can impose the county-based signature-gathering requirements if it concludes that the requirements would have no appreciable impact on voting rights. The Libertarian Party filed suit seeking a declaratory judgment and injunctive relief against the Arkansas Secretary of State, claiming that the ballot access statutory scheme violated the First and Fourteenth Amendments. During the Secretary's appeal of the district court's judgment, the Arkansas General Assembly amended its statute to allow new political parties to hold their nominating convention and submit their certificates of nomination at 12:00 p.m. on the day of the major parties' primary election. The Fifth Circuit held that the Libertarian Party's claim for declaratory relief has been rendered moot. Accordingly, the court vacated and remanded with directions to dismiss the complaint.
