After G.G., a transgender boy, began to use the boys’ restrooms with the approval of the school administration, the local school board passed a policy banning G.G. from the boys’ restroom. G.G. filed suit alleging that the school board impermissibly discriminated against him in violation of Title IX, 20 U.S.C. 1681(a), and the Equal Protection Clause of the Constitution. The district court dismissed G.G.’s Title IX claim and denied his request for a preliminary injunction. The court reversed the dismissal of G.G.’s Title IX claim, concluding that the district court did not accord appropriate deference to the relevant Department of Education regulations. In this case, the Department’s interpretation of its own regulation, 34 C.F.R. 106.33, as it relates to restroom access by transgender individuals, is entitled to Auer v. Robbins deference and is to be accorded controlling weight. The court also concluded that the district court used the wrong evidentiary standard in assessing G.G.’s motion for a preliminary injunction. The district court evaluated G.G.’s proffered evidence against a stricter evidentiary standard than is warranted by the nature and purpose of preliminary injunction proceedings to prevent irreparable harm before a full trial on the merits. Therefore, the district court abused its discretion when it denied the preliminary injunction without considering G.G.’s proffered evidence. Plaintiffs, nine students who were attending California public schools filed suit against the State and several state officials, seeking a court order declaring various provisions of California’s Education Code unconstitutional. Plaintiffs alleged that the provisions, which govern how K-12 public school teachers obtain tenure, how they are dismissed, and how they are laid off on the basis of seniority, violate the California Constitution’s guarantee that all citizens enjoy the “equal protection of the laws.” The trial court declared five sections of the Education Code unconstitutional and void. The court reversed, concluding that plaintiffs failed to establish that the challenged statutes violate equal protection, primarily because they did not show that the statutes inevitably cause a certain group of students to receive an education inferior to the education received by other students. Although the statutes may lead to the hiring and retention of more ineffective teachers than a hypothetical alternative system would, the statutes do not address the assignment of teachers; instead, administrators - not the statutes - ultimately determine where teachers within a district are assigned to teach. Critically, plaintiffs failed to show that the statutes themselves make any certain group of students more likely to be taught by ineffective teachers than any other group of students. Because plaintiffs failed to demonstrate that the statutes violate equal protection on their face, the court reversed the judgment. View "Vergara v. State of California" on Justia Law

Farmington School District appealed a Board of Education (state board) decision reversing the decision of the Farmington School Board (local board) not to renew the employment contract of Demetria McKaig, a guidance counselor at Farmington High School. In November 2012, a student (Student A) and her boyfriend told McKaig and another guidance counselor that Student A was pregnant and that she wanted to terminate her pregnancy. Student A was fifteen years old at the time. McKaig suggested that Student A tell her mother about the pregnancy, but Student A refused. The principal expressed his view that the school should inform Student A’s mother about the pregnancy. McKaig disagreed, asserting that Student A had a right to keep the pregnancy confidential. McKaig spoke with Attorney Barbara Keshen of the New Hampshire Civil Liberties Union about Student A’s situation. Keshen’s opinion was that the judicial bypass law protected the confidentiality of Student A’s pregnancy and the fact that she was contemplating an abortion. McKaig relayed this opinion to Student A, and Student A made an appointment with a health center and another attorney to assist her with the judicial bypass proceedings. Meanwhile, the principal instructed the school nurse to meet with Student A to tell her that the school would inform her mother about her pregnancy. McKaig told the principal about her conversation with Keshen and urged him to contact Keshen to discuss Student A’s rights. The principal did not contact Keshen; however, Keshen contacted him. He told Keshen that the parental notification and judicial bypass laws did not prevent him from telling Student A’s mother about the pregnancy. Keshen instituted a petition for a temporary restraining order (TRO) against the principal to prevent him from contacting Student A’s mother. McKaig was named as the petitioner “ON BEHALF OF [Student A]”; she was not named in her individual capacity. The TRO was ultimately granted. Months later, McKaig received a notice of nonrenewal from the superintendent; in the written statement of the reasons for non-renewal, the superintendent listed three reasons: insubordination, breach of student confidentiality, and neglect of duties. After the hearing, the local board upheld McKaig’s nonrenewal on those grounds. McKaig appealed to the state board, which found, pursuant that the local board’s decision was “clearly erroneous.” The state board reversed the local board’s decision to uphold McKaig’s nonrenewal, but it did not order McKaig’s reinstatement or any other remedy. McKaig cross-appealed the state board’s decision and argued that she was entitled to reinstatement with back pay and benefits. The Supreme Court affirmed the state board’s reversal of the local board’s decision, and ordered that McKaig be reinstated to her former job. Parents of a severely disabled child (T.R.) prevailed in a suit against the school district where the child was abused by his special education teacher. A jury awarded a substantial verdict and the school district challenged the verdict, alleging that the parents are not the proper parties to file suit. In this case, the victim was a minor when the challenged conduct occurred but turned 18 by the time of trial; his disability rendered him incompetent even after he reached majority; a bank had been appointed to serve as his guardian; and that same bank oversaw a trust that paid for the minor’s medical bills. The court concluded that the parents have Article III standing to directly seek past medical expenses and to seek future home care expenses on behalf of T.R.; the Bank, as guardian, should have filed suit to recover the claims T.R. would otherwise possess - those for future home care expenses, physical pain and anguish, and impairment - by suing in their name on his behalf; the Bank owed a fiduciary duty to T.R., and absent a showing of conflict, the parents could not circumvent the Bank by filing suit on T.R.'s behalf; the court found that the district court's refusal to allow ratification of the parents' actions was an abuse of discretion because nothing in the text of Federal Rule 17(a)(3) or the court's decisions applying it supports the district court's decision; and federal statutes at issue do not authorize recovery for the parents' mental anguish based on the mistreatment of their son. DS attended Rutledge School, 2010-2012 as a seventh and eighth grader, where he was was involved in several verbal and physical altercations with other students. DS and his mother repeatedly complained to school officials that other students were bullying DS. School officials investigated these complaints, disciplined the students found culpable, and took other proactive measures such as placing DS in different classes from his alleged harassers. Despite these efforts, DS continued to have problems with other students, culminating in an attack in the school bathroom that led DS to transfer to another school. The Sixth Circuit affirmed dismissal of a complaint alleging violation of Title IX of the Education Amendments of 1972 and deprivation of DS’s constitutional rights to equal protection and substantive due process under 42 U.S.C. 1983. There was no evidence concerning how the defendants treated other students—male or female, heterosexual or homosexual—who similarly complained about bullying. “The law does not require that [defendants] . . . have a pleasant demeanor” in responding to harassment, but only that they respond to it in a manner that is not clearly unreasonable; the defendants acted on DS’s complaints. A.G. and her parents filed suit against defendants, alleging claims of discrimination under section 504 of the Rehabilitation Act, 29 U.S.C. 794, and Title II of the Americans with Disabilities Act, 42 U.S.C. 12131–12134, as well as tort claims under Arizona state law. The district court granted summary judgment on these claims for defendants. Defendants cross-appealed, challenging the district court’s order vacating taxation of costs. The parties settled on other claims, including claims under the Individuals with Disabilities in Education Act, 20 U.S.C. 1400–1491. First, the court clarified federal legislation addressing special education for disabled children. The court concluded that the district court improperly dismissed A.G.’s meaningful access and reasonable accommodation arguments. The court concluded that a triable factual dispute exists as to whether the services plaintiffs fault the school district for failing to provide were actually reasonable, necessary, and available accommodations for A.G. Therefore, the court reversed the district court's order granting summary judgment in favor of the school district on plaintiffs’ section 504 and Title II claims and remanded for further consideration. In regard to the state law claims, the court concluded that plaintiff's intentional infliction of emotional distress (IIED) claim was correctly dismissed because there is no material issue of fact concerning the school district's conduct. Plaintiffs' negligent infliction of emotional distress (NIED) claim was also correctly dismissed where the district court found the facts alleged by plaintiffs did not rise to the predicate level typically required for such a claim in Arizona. The court reversed the district court’s summary judgment on claims for assault and battery where plaintiffs introduced evidence that creates an issue of fact as to whether the school district defendants physically escorted and restrained A.G. when she was not a danger to herself or others and despite knowing of her tactile sensitivity. Finally, the court reversed the district court's summary judgment on the false imprisonment claim where plaintiffs introduced evidence sufficient to create a genuine issue of material fact as to whether A.G. was a danger to herself or others when school district staff restrained her. C.V. was a seven-year-old second grade student at an elementary school operated by Albuquerque Public Schools (“APS”). He was eligible for special education benefits for autism. One morning in 2011, C.V. disrupted his class, ran away from APS staff, kicked an APS social worker, and kicked and shot rubber bands at APS School Security Officer Xiomara Sanchez. To protect C.V. and others, Officer Sanchez handcuffed him to a chair. Before doing so, Officer Sanchez had called C.V.’s mother, who granted permission to restrain him, and repeatedly warned C.V. to calm down. Officer Sanchez was unaware of C.V.’s disability. C.V.’s parents sued under Title II of the Americans with Disabilities Act (“ADA”), claiming APS denied C.V. a protected benefit and discriminated against him. In November 2010, Board of Education Chief Area Officer Coates sent Bordelon , the long-tenured principal of the Kozminski Academy, notice of a pre‐discipline hearing based on insubordination in failing to respond to a parent issue; failing to arrange a requested meeting regarding the arrest of Kozminski students; and failing to respond to Coates’s email. Bordelon received a five‐day suspension without pay, which he never served. In December 2010, Coates evaluated Bordelon as needing improvement, noting that Kozminski was on academic probation for a second year with test scores trending downward. Coates reassigned Bordelon to home with full pay pending an investigation into improperly replacing asbestos‐containing tile at Kozminski; purchasing irregularities; and tampering with school computers in a manner that impeded Board access to Kozminski’s records. In early 2011, Kozminski's Local School Council voted to not renew Bordelon’s contract. Bordelon, age 63, believed that Coates, exercised undue influence over the decision, based his age, in violation of the Age Discrimination in Employment Act, 29 U.S.C. 623. The Seventh Circuit affirmed summary judgment in favor of the Board, stating that that Bordelon did not prove discrimination and that there was substantial evidence of independent reasons for not renewing Bordelon’s contract, making it unlikely that Coates influenced the Board. Three special-education students claimed that Kowalski abused her students during the 2003–2004 school year by, among other things, gagging one student with a bandana to stop him from spitting, strapping another to a toilet to keep her from falling from the toilet, and forcing another to sit with her pants down on a training toilet in full view of her classmates to assist her with toilet-training. They alleged that Kowalski’s supervisors were deliberately indifferent to this alleged abuse, and that North Point created an environment primed for abuse by its adoption of allegedly unconstitutional policies and practices. The district court granted summary judgment to all defendants in the suit under 42 U.S.C. 1983, because Kowalski’s instructional techniques, while inappropriate and even “abusive,” did not rise to the conscience-shocking level required of a substantive due process claim; because Kowalski’s supervisors had insufficient notice of her actions to be found deliberately indifferent; and because North Point’s policies and practices were not constitutionally inadequate. The Sixth Circuit affirmed, stating that, as a matter of law, Kowalski’s conduct did not violate the Fourteenth Amendment. View "Domingo v. Kowalski" on Justia Law
