Petro v. Palmer College of Chiropractic
The Supreme Court affirmed the judgment of the district court dismissing Plaintiff's claims for violations of a municipal civil rights ordinance and the Iowa Civil Rights Act (ICRA) and breach of contract, holding that the ICRA does not contain authorization for a municipality to enact law that would be binding between two private parties in state court.Plaintiff claimed that he was discriminated against in his education on the basis of age and disability. The district court dismissed all of Plaintiff's claims, concluding that it had no jurisdiction over the local ordinance claims, that the ICRA claims were barred because they were based on the same conduct, and that Plaintiff did not have a viable breach of contract claim. The Supreme Court affirmed, holding (1) the general assembly did not confer jurisdiction on Iowa state courts to hear claims by private parties arising under municipal civil rights ordinances; and (2) the district court did not err in its resolution of Plaintiff's ICRA and breach of contract claims. Squeri v. Mount Ida College
The First Circuit affirmed the judgment of the district court granting Defendants' motion to dismiss Plaintiffs' complaint alleging that Defendants knew that Mount Ida College was on the brink of insolvency but concealed this information, holding that Plaintiffs' claims were properly dismissed.Mount Ida, a higher education institution in Massachusetts, permanently closed after providing its students six weeks' notice that it was closing. Plaintiffs, current and prospective students, brought a putative class action against Mount Ida, its board of trustees, and five Mount Ida administrators (collectively, Defendants), alleging seven Massachusetts state law claims. The district court dismissed the complaint. The First Circuit affirmed, holding (1) Plaintiffs' breach of fiduciary duty claim failed; (2) the district court did not err in dismissing Plaintiffs' violation of privacy claim; (3) no claims were stated for fraud, negligent misrepresentation, or fraud in the inducement; (4) Plaintiffs' allegations did not plausibly allege a breach of implied contract; and (5) the district court properly dismissed Plaintiffs' Mass. Robinson v. Town of Marshfield
The First Circuit affirmed the district court's grant of summary judgment on Appellant's federal law claims under the Age Discrimination and Employment Act, and on the state-law claims for discrimination, retaliation based on a complaint of age discrimination, and failure to investigate and vacated the summary judgment on the state law claims for retaliation based on a report of gender discrimination, breach of contract, intentional interference with contractual relations, and defamation, holding that the court erred in granting summary judgment as to these claims.This lawsuit arose from events that led to Appellant's retirement from his position as Fire Chief for the Fire Department of the Town of Marshfield, Massachusetts. The district court granted summary judgment in favor of the Town on all of Appellant's federal and state law claims. The First Circuit affirmed in part and vacated in part, holding (1) summary judgment was properly granted as to some of Appellant's claims; but (2) as to the remaining state law claims, there was no analogue to the common law claims in the federal law claims that were addressed, and rather than attempt to resolve the state law issues that were in dispute as to these claims, their dismissal was directed without prejudice. Crosby v. City of Chicago
Crosby fell three stories from a window before Chicago Officer Gonzalez arrested him. Crosby maintains that Gonzalez intentionally pushed him through the window and then falsely claimed—with corroboration from other officers—that Crosby possessed a gun. Crosby was convicted and sentenced to eight years in prison. After an Illinois appellate court reversed his conviction, Crosby filed suit under 42 U.S.C. 1983, naming only Gonzalez and suing only for excessive force. The parties settled; the court dismissed Gonzalez’s claims with prejudice. The agreement was between Crosby, Gonzalez, and the city, though the latter had not been named as a defendant. It provided that Crosby would receive $5,000 to release "all claims he had or has against Gonzalez, the city, and its future, current or former officers … , including but not limited to all claims he had, has, or may have in the future, under local, state, or federal law, arising either directly or indirectly out of the incident which was the basis of this litigation." It stipulated that Crosby’s attorney read and explained its contents to Crosby.Three years later, Crosby filed another suit, naming the city, Gonzalez, and the officers who corroborated Gonzalez’s story, focusing on the alleged lie that he possessed a gun and his subsequent prosecution, conviction, and imprisonment. The court rejected the suit, awarding the city $2,131.60 for the printing of transcripts of Crosby’s state-court criminal proceedings. The Seventh Circuit affirmed. Crosby released all claims “arising either directly or indirectly out of the incident.” Even if “the incident” refers to Crosby’s fall rather than the arrest as a whole, Crosby’s claims regarding the coverup plainly “aris[e] from” the incident being covered up. The release language encompasses his claims for wrongs committed after his arrest. Crosby has not shown that the city’s requested costs were unreasonable. View "Crosby v. Creative Oil & Gas, LLC v. Lona Hills Ranch, LLC
In this case examining whether the former version of the Texas Citizens Participation Act (TCPA) applies to certain counterclaims alleged in a dispute over an oil and gas lease the Supreme Court affirmed in part and reversed in part the judgment of the court of appeals dismissing all the counterclaims in this case, holding that the court of appeals properly dismissed one counterclaim but erred in dismissing the remaining counterclaims.At issue was whether each counterclaim was "based on, relates to, or is in response to" the "exercise of the right of free speech" or the "exercise of the right to petition," as defined by the governing statutory text. See Tex. Civ. Prac. & Rem. Code 27.003(a). The Supreme Court held (1) certain communications to third parties about an oil and gas lease allegedly involving the exercise of free speech, on which some of the counterclaims were based, were not covered by the TCPA because they did not relate to a matter of public concern under the TCPA, and therefore, the court of appeals erred in dismissing these counterclaims; and (2) the court of appeals correctly disposed of the "right to petition" counterclaim. Long Beach Unified School District v. Margaret Williams, LLC
The Court of Appeal affirmed the trial court's dismissal of the school district's cross-complaint under the anti-SLAPP statute. In the underlying action, Margaret Williams and her LLC filed suit against the school district, alleging that her termination was retaliatory. Williams also alleged that the school district unlawfully caused her arsenic poisoning.The court explained that, if the court were to enforce the school district's request, the indemnity provision would require Williams LLC to fund the school district's defense against the very litigation the LLC and Williams brought against the school district. Therefore, the school district's cross-complaint arose from that litigation or the LLC's refusal to sabotage it -- each of which was protected by the anti-SLAPP statute. Furthermore, the school district sought to require the LLC not only to fund the school district's defense, but also to reimburse the school district for any award secured by Williams or the LLC. The court explained that such a bar to meaningful recovery embodied a high degree of substantive unconscionability, sufficient -- when combined with the procedural unconscionability shown through Williams LLC's unrebutted evidence of adhesion, oppression, and surprise -- to establish that the indemnity provision was unconscionable. The court limited the provision to avoid an unconscionable result, and held that the school district failed to show error in the dismissal of the breach of contract and declaratory relief claims, as well as the dismissal of the school district's other cross-claims. Doe v. Trustees of Boston College
The First Circuit reversed the judgment of the district court granting a preliminary injunction prohibiting the Trustees of Boston College (BC) from imposing a suspension of one year on John Doe, a student, who was found to have engaged in the sexual assault of a female student, holding that the district court erred in finding a probability of success as to Doe's claim under Massachusetts contract law.The suspension decision in this case was the outcome of a disciplinary complaint filed against Doe, and the suspension decision was the outcome of the procedures set forth in BC's student sexual misconduct policy. In issuing the preliminary injunction the district court found Doe had shown a probability of success on the merits of the state law claim of violation of a contractual obligation of basic fairness. The First Circuit vacated the injunction, holding (1) to the extent the district court was attempting to base its ruling on a prediction of future developments in Massachusetts contract law, the court erred; and (2) where current Massachusetts law does not require the college discipline process Doe argues must be a part of a contractual obligation of basic fairness the court erred in granting the injunction. Singh v. Cordle
Beginning in 2009, Plaintiff Rajesh Singh worked as an untenured professor in the School of Library and Information Management (SLIM) at Emporia State University (ESU). He was informed in February 2014 that his annual contract would not be renewed. He sued ESU and various administrators in their individual capacities, asserting several retaliation and discrimination claims under Title VII of the Civil Rights Act of 1964; the Kansas Act Against Discrimination (KAAD); and the Civil Rights Act of 1871. The district court granted summary judgment for Defendants on every claim except one: a First Amendment retaliation claim under section 1983 against Provost David Cordle. Provost Cordle appealed the denial of summary judgment on the ground that he was entitled to qualified immunity. The district court then certified as final under Fed. R. Civ. P. 54(b) its order granting summary judgment on all other claims, and Plaintiff filed a cross-appeal, challenging the grant of summary judgment on Plaintiff’s claims: (1) ESU and the individual Defendants discriminated against him by not renewing his contract; and (2) ESU and the individual Defendants retaliated against him for filing discrimination complaints with ESU’s human resources department and the Kansas Human Rights Commission (KHRC). The Tenth Circuit found the claims against ESU were brought under Title VII and the KAAD, and the claims against the individual Defendants were brought under section 1983. The Court reversed the district court’s denial of summary judgment for Provost Cordle and affirmed grants of summary judgment on the remaining claims. Cordle was entitled to qualified immunity because he could have reasonably believed that the speech for which he allegedly punished Plaintiff was not on a matter of public concern. As for the discrimination claims, the district court properly granted summary judgment because Plaintiff did not establish a genuine issue of fact that ESU’s given reason for his nonrenewal, that he was noncollegial, was pretextual. “Although Plaintiff contends that these discrimination claims survive under the cat’s-paw theory of liability, he does not provide adequate evidence that the allegedly biased supervisor - his school’s dean - proximately caused the ultimate nonrenewal decision.” The Court affirmed summary judgment on Plaintiff’s retaliation claims because he failed to present adequate evidence that the ESU employees who allegedly retaliated against him knew that he had filed formal discrimination complaints. In re Gestational Agreement
The Supreme Court reversed the judgment of the district court denying the petition filed by Petitioners, a same-sex married couple and a woman and her husband requesting that the court validate their agreement that the woman act as a gestational surrogate for the couple, holding that Utah Code 78B-15-802(2)(b), which precludes same-sex male couples from obtaining a valid gestational agreement, is unconstitutional.A married couple, both men, entered into an agreement with a woman and her husband to have the woman act as a gestational surrogate to carry a fertilized embryo that contained the genetic material of one of the couple. This type of gestational agreement is not enforceable in Utah unless it is validated by a tribunal, and a court may not validated the agreement if medical evidence is not presented showing that the "intended mother" is unable to bear a child or will suffer health consequences if she does. Petitioners filed a petition requesting that the district court validate their gestational agreement, but the court denied the petition because neither of the intended parents were women. The Supreme Court reversed, holding that the statute is unconstitutional and that the unconstitutional subsection should be severed. The Court then remanded this case for further proceedings. G. v. Fay School
The First Circuit affirmed the judgment of the district court in favor of the Fay School, Inc. and Fay's Head of School as to Appellants' complaint alleging unlawful retaliation for demands for an accommodation for a certain condition of G., a twelve-year-old minor, holding that the district court correctly denied Appellants' claims.G., a former student of the Fay School, and her parents (collectively, Appellants) brought this suit against Fay after the school refused to remove wireless internet from its classrooms to accommodate G.'s alleged electromagnetic hypersensitivity (EHS), a sensitivity to electromagnetic fields. Appellants alleged, among other claims, unlawful retaliation for an accommodation for G.'s condition, in violation of Title V of the Americans with Disabilities Act, 49 U.S.C. 12203(a), breach of contract, and misrepresentation. The First Circuit affirmed, holding (1) damages are not an available remedy for a Title V retaliation claim premised upon an exercise of rights under Title III of the ADA; and (2) Appellants failed to raise triable issues of fact as to their contract and misrepresentation claims.
