Petitioner filed an application for a writ of habeas corpus under 28 U.S.C. 2254, seeking relief from his convictions in Maryland state court for attempted first degree murder, first degree assault, use of a handgun in the commission of a crime of violence, and second degree assault. Petitioner's conviction stemmed from domestic abuse incidents involving his ex-wife where he ultimately shot her.Petitioner claims that he is entitled to habeas relief because (1) he did not knowingly and voluntarily waive his right to a jury trial, in violation of Patton v. United States, 281 U.S. 276 (1930); (2) the prosecution suppressed material evidence, in violation of Brady v. Maryland, 373 U.S. 83 (1963); and (3) he received ineffective assistance from his legal counsel, in violation of Strickland v. Washington, 466 U.S. 668 (1984). The district court granted relief in part on the Patton and Brady claims, dismissing the Strickland claims without prejudice.The Fourth Circuit held that the district court's decision to grant petitioner habeas relief runs contrary to the deference that federal courts are required to afford state court adjudications of federal constitutional claims. In regard to the Patton claim, the court concluded that the state court's adjudication of petitioner's challenge to his waiver was not unreasonable under the standards of the Antiterrorism and Effective Death Penalty Act (AEDPA). The court explained that petitioner failed to make a plain showing that his waiver was not knowing and voluntary.In regard to the Brady claims, the court concluded that petitioner was not entitled to relief in regard to his paid informant claim, more lenient treatment claim, claims arising out of the government witness and the ex-wife's affidavit, as well as petitioner's claim regarding the alleged confession of other deaths. Finally, because the district court declined to consider petitioner's claims of ineffective assistance of counsel under Strickland, and dismissed them without prejudice, the court also vacated this judgment. The Fourth Circuit affirmed the district court's denial of habeas relief under 28 U.S.C. 2241. Petitioner claims that, pursuant to United States v. Wheeler, 886 F.3d 415 (4th Cir. 2018), the district court was permitted to address the merits of his petition.The court declined to hold that the explanation in Mathis v. United States, 136 S. Ct. 2243 (2016), about how to determine whether parts of a statute are "elements or means" changed this circuit's substantive law applying the modified categorical approach to South Carolina third degree burglary. The court explained that, to the extent petitioner contends Mathis changed settled substantive Supreme Court law, Mathis itself made clear that it was not changing, but rather clarifying, the law. To the extent petitioner contends Mathis changed settled Fourth Circuit law, the court rejected such contentions. Furthermore, petitioner's arguments relying on three other circuit cases failed because these cases do not utilize a test like Wheeler. The Eleventh Circuit sua sponte vacated its previous opinion and substituted the following opinion.These appeals arose from a Title VII action filed by four ultrasound technologists against the Secretary, alleging that their supervisors and coworkers retaliated against them and subjected them to a hostile work environment at the Tampa VA because they engaged in protected EEOC activity. One plaintiff also alleged that she was subjected to a hostile work environment based on her sex. The district court granted summary judgment in favor of the Secretary. Because two intervening decisions changed the law applicable to plaintiffs' discrete retaliation claims and retaliatory hostile work environment claims, the court remanded those claims to the district court with the instruction that it analyze the claims consistent with the intervening decisions. Because the intervening decisions did not, in the court's judgment, affect the resolution of the sex-based hostile work environment claim in this case, the court considered that claim alone and affirmed the district court's decision to enter summary judgment for the Secretary.In this case, the court concluded as an initial matter that most of the named co-worker's conduct lacks the necessary sexual or other gender-related connotations to be actionable sex discrimination. The court explained that nothing in the record allows the conclusion that the coworker's conduct had anything to do with plaintiff's sex; the context surrounding the coworker's inappropriate touching of plaintiff shows that the touching was not sex based; and there is no evidence suggesting that the angry looks, harsh words, and silent treatment that the coworker gave plaintiff were influenced by plaintiff's sex. Even if the coworker's conduct was based on plaintiff's sex, her claim would still fail because the conduct is insufficiently severe or pervasive to alter the terms and conditions of plaintiff's employment. In 2008, Murray was sentenced to life in prison without the possibility of parole (LWOP) for a first-degree special circumstance murder he committed when he was 22 years old. In 2020, Murray unsuccessfully sought a Franklin hearing, contending he was eligible for a youth offender parole hearing under Penal Code section 3051. The court cited section 3051(h), “people sentenced to life without the possibility of parole for crimes committed when they were at least 18 years of age but no more than ‘25 years of age or younger are not eligible for youth offender parole hearings.” The court of appeal affirmed.Meanwhile, Murray sought habeas corpus relief, asserting an equal protection violation, arguing that section 3051(h) violates his right to equal protection by affording juvenile LWOP offenders (those under 18 at the time of their offense) a youth offender parole hearing while denying youthful LWOP offenders (those 18-25 years old at the time of their offense) a hearing. The court of appeal denied relief. There is a rational basis for distinguishing between juvenile and youthful LWOP offenders; children are constitutionally different from adults for purposes of sentencing. Nian worked as a home healthcare mentor for a family with a special-needs child, “SG.” After one visit, SG’s sister, JCG, claimed that Nian entered her room, tried to kiss her, put his hands on her private areas, and then pulled down her leggings and tried to perform oral sex on her. Her mother called the police and took JCG to the hospital. Nian was found guilty of rape by cunnilingus. Nian later sought a new trial, based on an affidavit from a juror, Cox, stating that another juror had introduced into deliberations facts about Nian being from Sierra Leone and having a prior criminal record, which she felt influenced the verdict. After holding an evidentiary hearing, the court excluded Cox’s testimony under Ohio Rule of Evidence 606(B) (aliunde rule) and denied Nian’s request for a new trial. The court stated that it questioned the credibility of the proffered testimony. The Ohio Court of Appeals affirmed.The Sixth Circuit reversed the denial of Nian’s petition for habeas relief. it is a constitutional error for a state court to use Ohio’s aliunde rule to exclude evidence of a jury’s consideration of extraneous information. When the state called Blackwell to testify at Miller's trial for the 1995 murder of Rice, she claimed that she could not remember anything about the day in question. Out of the jury’s presence, the judge sent Blackwell to jail to read statements that she had given to police shortly after the murder and notes that Miller’s investigator took when speaking with her. Blackwell returned to court and testified, consistently with her police statement, that the morning after the murder, she saw Miller in a car that looked like Rice’s and that Miller told her that Rice was dead before anyone else could have known. During cross-examination, Miller’s attorney asked Blackwell how she had regained her memory. Blackwell replied: “I don’t want to go to jail.”The Tennessee Court of Criminal Appeals ordered a new trial. Blackwell was unavailable. Rather than allow all of Blackwell’s testimony to be read to the jury, the court carved “any reference of incarceration or intimidation.” The jury never heard Blackwell’s statement that she did not want to go to jail. The rest of the prosecution’s case relied heavily on the testimony of a single eyewitness, who had credibility problems. Convicted, Miller received a life sentence. The Tennessee Court of Criminal Appeals rejected Miller’s claim that the court erred in admitting Blackwell’s redacted testimony.The Sixth Circuit reversed a denial of habeas corpus relief. Confrontation of an adverse witness necessarily entails that the trier of fact be allowed to learn the material results of that confrontation. The Shelby County Sheriff’s Department dispatcher alerted three deputies that a 911 caller, Nancy Lewellyn, had told the dispatcher that she was suicidal, that she had a gun (possibly a .45 caliber pistol), and that she would kill anyone who came to her residence. Each squad car was equipped with a dashboard camera, which recorded video, sound, and the time of day. At 12:14 p.m., Lewellyn walked outside and turned toward her driveway, carrying in her right hand a BB handgun that resembled a .45 caliber pistol. She began to raise that handgun. The deputies yelled to her then fired shots. Lewellyn continued walking with her right arm extended and the pistol pointing toward her car, Lewellyn leaned on its hood briefly, then turned back toward the house. The shooting continued. Llewellyn collapsed; 11 seconds had elapsed since she exited her house. Ten shots were fired. Lewellyn had deposited the handgun on the sedan’s hood before turning back. The deputies approached and discovered that she was unarmed. Lewellyn died at the scene.In a suit under 42 U.S.C. 1983, the district court rejected the deputies’ claims of qualified immunity. The Sixth Circuit vacated. The reasonableness of a particular use of force must be judged from the perspective of a reasonable officer on the scene, rather than in hindsight. The “facts and circumstances” support the deputies’ contention that reasonable officers would perceive that Lewellyn posed an immediate threat to their safety. View "Cunningham v. Plaintiff filed suit against Ford under the Family and Medical Leave Act (FMLA), the Americans with Disabilities Act (ADA), and the Missouri Human Rights Act (MHRA), claiming that Ford terminated him twice and took other adverse employment action against him based on his asthma and scoliosis. The district court dismissed the FMLA claim as time-barred, and dismissed his ADA and MHRA claims on the ground that he exhausted his administrative remedies.The Eighth Circuit concluded that FMLA claims were sufficient to survive a Federal Rule of Civil Procedure 12(b)(6) motion. The court also concluded that plaintiff has cleared the exhaustion hurdle on his MHRA claim but has pulled up short on his three ADA claims. The First Circuit affirmed the district court's grant of summary judgment in favor of Defendants - the City of Framingham and Chief of the Framingham Police Department - in this Garcetti speech-retaliation and Massachusetts Whistleblower Act action brought by Plaintiff, an FPD detective, holding that the district court did not err.Plaintiff brought this lawsuit challenging allegedly retaliatory employment actions, including a five-day suspension and his being put on paid administrative leave during an investigation. The district court granted summary judgment for Defendants, concluding that Defendants met their burden to show that the adverse employment decisions would have occurred despite Plaintiff's protected speech. The 1972 Shakman Decree enjoined the City of Chicago and county officials from governmental employment practices based in politics. A 1983 Decree enjoined those officials from conditioning hiring or promotions on any political considerations. After the Supreme Court held that the First Amendment’s prohibition against patronage-based firings extends to promotion, transfer, recall, or hiring decisions involving public employment for which party affiliation is not an appropriate requirement, the Clerk of Cook County entered a separate consent decree. In 1992 the Voters Organization joined the Shakman complaint. The court has dismissed some entities and officials, including Chicago and its Park District, as showing substantial compliance. In 2010 the Clerk and other defendants consented to a magistrate judge conducting further proceedings. A new magistrate and a new district judge were assigned in 2020.In 2019, plaintiffs moved for supplemental relief. The magistrate found that the Clerk violated the 1991 Decree, that the evidence strongly suggested that the Clerk’s policy of rotating employees was “instituted for the purpose" of evading the 1972 Decree, appointed a special master to oversee compliance within the Clerk’s Office, and refused the Clerk’s request to vacate the Decrees. The Seventh Circuit, noting that it lacked authority to review the appointment of the special master, affirmed the denial of the request to vacate. Sounding a “federalism concern,” the court noted the permitting a consent decree over an arm of state or local government to remain on a federal docket for decades is inconsistent with our federal structure.
