The Supreme Court affirmed the judgments of the superior court convicting Defendant following a jury trial for larceny of an automobile and adjudicating him a probation violator, holding that Defendant was not entitled to relief on his claims of error.On appeal, Defendant argued, among other things, that the trial court erred in denying his motion to suppress certain evidence collected as a result of a warrantless search of his real-time cell-site location information (CSLI). The Supreme Court disagreed and affirmed, holding (1) the acquisition of real-time CSLI qualifies as a search under the Fourth Amendment for which a warrant is required; (2) any error in the trial justice's determination that the exigent circumstances exception to the warrant requirement applied to the facts of this case was harmless; (3) the trial justice did not abuse his discretion in denying Defendant's motion to exclude certain testimony, and any error in allowing other testimony to be admitted at trial was harmless; and (4) Defendant waived his last argument for appeal. The Supreme Court reversed the decision of the court of appeals affirming the decision of the circuit court to suppress the results of a search of Defendant, holding that the law enforcement officers had probable cause to arrest Defendant, and therefore, the underlying search was a lawful search incident to arrest.A police officer executed a traffic stop of Defendant for speeding and, during her initial contact with Defendant, "detected an odor of raw marijuana." The officer called for back-up, and two officers escorted Defendant out of the vehicle. The officers proceeded to search Defendant based on the odor of marijuana and found two baggies containing cocaine and fentanyl. Defendant filed a motion to suppress on the grounds that the State lacked probable cause to arrest and search him. The circuit court granted the motion, and the court of appeals affirmed. The Supreme Court reversed, holding that, under the totality of the circumstances, the officers had probable cause to arrest Defendant on the belief that he was committing or had committed a crime, and therefore, there was no Fourth Amendment violation. Plaintiff, a Baton Rouge police officer, sued Defendant, the organizer of a protest after Plaintiff was seriously injured by a protestor at a protest Defendant arranged. After a lengthy procedural history, the case came back to the Fifth Circuit after the Supreme Court of Louisiana affirmed that state law recognizes a negligence cause of action in the circumstances alleged in Plaintiff's complaint.In turn, the Fifth Circuit reversed the district court's order dismissing Plaintiff's negligence claim. Additionally, due to these developments, the district court also erred in failing to grant Plaintiff leave to amend his complaint. Plaintiff-appellant Sharhea Wise worked as a mail carrier for the United States Postal Service. When she got pregnant, she asked to avoid handling heavy items. The Postal Service agreed to provide help when items were too heavy, but Wise needed to tell someone when she needed help. On two occasions, Wise allegedly had to handle items that were too heavy. Both times, she blamed the Postal Service for failing to accommodate her need for help. The Postal Service argued in response that Wise hadn’t asked for help. Days after Wise allegedly had to handle the heavy items, she walked off the job and the Postal Service fired her. Wise claimed retaliation, attributing the firing to her requests for help. The Postal Service denied retaliation, explaining that it had fired Wise because she walked off the job. Wise characterized this explanation as pretextual. The district court granted summary judgment to the Postal Service, and Wise challenged the rulings. The Tenth Circuit agreed with her challenge on the failure-to-accommodate claim. "On this claim, a reasonable factfinder could find that the Postal Service had failed to accommodate Ms. Wise’s need to avoid handling heavy items." But the Court agreed with the grant of summary judgment on the retaliation claim because: (1) the Postal Service presented a neutral, nonretaliatory explanation for the firing; and (2) Wise lacked evidence of pretext. Believing that two men were about to engage in the armed robbery of a gas station, defendant police officers ("Defendants") approached the Plaintiff's’ vehicle with guns pointed and forcibly removed him. The district court denied the Defendants' claim to qualified immunity, and the Defendants appealed.On appeal, the Ninth Circuit reversed. First, it was not clearly established that the officers lacked an objectively reasonable belief that criminal activity was about to occur. Second, clearly established law did not prevent the officers from suspecting Plaintiff might be armed. Here, Defendants believed Plaintiff was about to commit and armed robbery, which is a crime typically involving the use of a weapon. Nothing gave the panel any reason to second guess the officer's "on the ground" determination.The court also rejected Plainitff's claim that it was a violation of a clearly established right to point a firearm at the Plaintiff and demand he exits his vehicle without first identifying themselves as law enforcement. The Supreme Court affirmed the judgment of the district court denying Defendant's motion to suppress evidence of drugs and entering judgment on Defendant's plea of guilty to possession of cocaine with intent to distribute, holding that there was no error or abuse of discretion.Defendant was pulled over by a New Hampshire police officer, Stephen DiChiara, following a suspected drug buy. DiChiara was asked to conduct the stop by a United States Drug Enforcement Agency (DEA) task force officer, DiChiara stoped and seized the car Defendant was driving. A subsequent search of the car revealed uncovered roughly one kilogram of cocaine. Defendant moved to suppress evidence of the drugs, arguing that DiChiara could not act solely on the DEA officer's probable cause. The Supreme Court reversed the judgment of the district court denying Thomas L. Cardella & Associates' (Cardella) motion for judgment notwithstanding the verdict in this case alleging common law negligent supervision or retention, holding that the claim was barred by the Iowa Workers' Compensation Act (IWCA), Iowa Code ch. 85.Plaintiff sued Cardella two years after she quit her employment there. Because she missed the deadline for bringing a hostile work environment claim under the Iowa Civil Rights Act (ICRA), Iowa Code ch. 216, Plaintiff sued for common law negligent supervision or retention and presented her claim to the jury seeking emotional distress damages related to her mental health as a negligent supervision claim premised on Cardella failing to protect her from assault and battery. After a trial, the jury awarded Plaintiff $400,000 in emotional distress damages. The Supreme Court reversed, holding that, as presented to the jury, Plaintiff's claim was barred by IWCA. The Supreme Court affirmed Defendant's conviction of second degree murder, unlawful discharge of a firearm, and two counts of use of a weapon to commit a felony, holding that there was no error in the trial judge's evidentiary rulings.On appeal, Defendant argued that the district court erred in admitting evidence of his character, specifically that he conducted drug deals after the murder, he was the victim of a robbery, and he owned firearms. Defendant also challenged cellular telephone information obtained from a "tower dump." The Supreme Court affirmed, holding (1) there was no error in the admission of the challenged evidence; and (2) even if the cell phone tower dump was not a search and subject to Fourth Amendment protections, the order under 18 U.S.C. 86-2,106 allowing the dump was executed in good faith. The Supreme Judicial Court vacated Defendant's convictions for five counts of trafficking a person for sexual servitude and a second and subsequent offense of possession of a class A substance with intent to distribute, holding that the conflict of interest inherent in counsel's bigotry against persons of Defendant's faith and race deprived Defendant of his right to effective assistance of counsel.Defendant, a Black man of the Muslim faith, was appointed counsel who openly shared his hatred of and bigotry against people of the Muslim faith and his racism against Black persons. Counsel advised Defendant to accept a plea deal, which Defendant did. Defendant later filed a motion to withdraw his guilty plea and for a new trial, arguing that his counsel had an actual conflict of interest. The motion judge denied the motion. The Supreme Judicial Court reversed and remanded the case for a new trial, holding that Defendant met his burden to establish that counsel's representation of him was impaired by an actual conflict of interest. Plaintiff, a convicted sexually violent predator, was held in the Lubbock County Detention Center as a pre-trial detainee for approximately one month from December 2017 to January 2018. Soon after his arrival, he was placed in administrative segregation away from the facility’s general population, where he was held for most of the remainder of his time there. He subsequently brought suit under 42 U.S.C. Section 1983 against Lubbock County and several law enforcement officials, asserting a series of claims regarding his alleged mistreatment there. The district court entered an order dismissing the claims against the county and all but one of the officials, which he now appeals in the first of the consolidated cases. Plaintiff challenged the process by which he was placed and remained in administrative segregation. After the district court subsequently dismissed the remaining named official, Plaintiff moved to reconsider that dismissal and the dismissal of several of his other claims. The district court rejected both motions for lack of new evidence, which Plaintiff appealed in the second of the consolidated cases. The Fifth Circuit affirmed, finding no reversible errors.
