Plaintiff, a California state prisoner, moved to recall the mandate and reinstate his 2017 appeal of the dismissal of his civil rights action against state agencies and Salinas Valley Prison medical staff and officials.   The Ninth Circuit denied the motion to reinstate the appeal but directed that his filing fees be refunded. The panel first determined that Plaintiff’s motion to recall the mandate, filed 661 days after the mandate became effective, was untimely. The panel next held that the extraordinary remedy of recalling the mandate and ordering reinstatement to prevent injustice or address exceptional circumstances was not necessary given that Plaintiff did not dispute that he had three strikes, was ineligible to proceed IFP under Section 1915(b)’s payment plan, and had not timely paid the filing fee. The appeal therefore was properly dismissed. The panel held that Section 1915 neither permits nor requires the collection of fees from a prisoner who is ineligible for IFP status because he has struck out under Section 1915(g). Plaintiff purported IFP appeal therefore was barred by 1915(g), and the district court was without authority to collect the filing fees from Plaintiff’s prison account. View "LEON MEYERS V. Plaintiff worked as a hospital nurse for St. Vincent’s Health System. After St. Vincent’s fired her, Plaintiff sued, alleging race discrimination and retaliation under Title VII and 42 U.S.C. 1981. The district court granted summary judgment for St. Vincent’s, and Plaintiff appealed.On appeal, Plaintiff claimed she presented sufficient evidence to survive summary judgment as to all her claims. She also claimed that the district court erred in applying the McDonnell Douglas framework to a “mixed-motive” retaliation claim.The Eleventh Circuit held that Plaintiff's hostile work environment claim failed because there was no evidence of severe or pervasive harassment; Bostock v. Clayton County, 140 S. Ct. 1731 (2020) did nothing to undermine the application of McDonnell Douglas to retaliation claims because but for causation still applies; Plainitff's retaliation claim cannot survive; and disparate-treatment claim fails because there is no evidence that race played a role in her termination. Parolees sued the Missouri Department of Corrections (MDOC), claiming that its parole revocation system violated the Due Process Clause. Recognizing the system’s flaws, MDOC rewrote its policies and consented to summary judgment. Later, MDOC moved to dismiss for failure to join a required party—the Missouri Public Defender Commission (Commission). The district court denied MDOC’s motion and held a hearing to determine whether MDOC’s revised policies satisfied due process. Finding additional problems, the district court issued a remedy order instructing MDOC to make changes.   The Eighth Circuit affirmed in part, reversed in part, and remanded. The court explained that the state must hold a revocation hearing “within a reasonable time after the parolee is taken into custody.” The court wrote that MDOC has a policy requiring a revocation hearing within 30 days, but it does not always follow that policy. The district court ordered MDOC to follow its 30-day policy. The court wrote that because it has held that longer delays may be reasonable in some cases, the remedy is not tailored to the violation and was an abuse of discretion. View "Stephanie Gasca v. Appellant suffers from various mental health conditions. Appellant’s delusions led her to believe that the federal government— specifically, former President Barack Obama—was conspiring with hip-hop mogul Jay-Z and other members of the music industry to harm Appellant and her family. To send a message to these government conspirators, Appellant threw a Molotov cocktail into the lobby of the U.S. Citizenship and Immigration Services field office in Oakland Park, Florida. Appellant was indicted and the parties jointly requested an evaluation of whether she was competent to stand trial. The court determined, based on medical evaluation, that Appellant was “presently not competent to stand trial” and therefore ordered her committed to the custody of the Attorney General for hospitalization and treatment pursuant to 18 U.S.C. Section 4241(d). Appellant contends that the district court lacked statutory authority to order her indefinite civil commitment pursuant to 18 U.S.C. Section 4246.   The Fifth Circuit affirmed.  The court explained that Section 4241(d) sets forth two time periods during which a criminal defendant is committed to the custody of the Attorney General. The court explained that Appellant was never rendered competent to stand trial. Second, the court noted that Appellant’s criminal charges were still pending when the dangerousness certificate was filed on December 17, 2020. Third, Appellant does not argue that her three months of additional confinement between September and December 2020 was of unreasonable duration. Accordingly, Appellant remained in the custody of the Attorney General pursuant to  4241(d) on December 17, 2020, and was therefore properly subject to indefinite-civil-commitment proceedings under 4246. Plaintiff was hired as the Superintendent of Dothan City Schools in Dothan, Alabama. The employment contract stated Plaintiff could only be terminated for cause. Furthermore, the contract stated that the termination would not be effective until the Board provided Plaintiff with a statement of the cause for termination and allowed her an opportunity for a hearing. Lastly, the employment contract provided that Plainitff could resign with or without cause as long as she gave at least 120 days notice in writing of her resignation to the Board. Six days after Plaintiff’s intent to resign was sent, Plaintiff alleges that the Board voted to terminate Plaintiff’s contract. She brought claims for deprivation of due process and the Fifth and Fourteenth Amendments, conspiracy to violate civil rights in violation of 42 U.S.C. Section 1985, and breach of contract. The district court dismissed Plaintiff’s claims with prejudice.   The Eleventh Circuit reversed the district court’s denial of Plaintiff’s due process claims and affirmed the district court’s denial of Plaintiff’s conspiracy and breach of contract claims. The court explained that instead of construing all ambiguities in Plaintiff’s favor, the district court used the minutes to recharacterize the allegations within Plaintiff’s complaint. When taking the factual allegations in Plaintiff’s complaint as true, there is a plausible claim for relief. In paragraph 18 of the complaint, Plaintiff’s classifies her communication as an “intent” to resign, not an actual resignation. The court wrote that the district court erred by ignoring that Plaintiff had a plausible claim to relief and not drawing reasonable inferences in her favor. View "Phyllis Edwards v. Plaintiff, a black nurse who was disciplined and ultimately fired by her employer, Public Health Trust of Miami-Dade County—appealed the district court’s entry of summary judgment on her Title VII and state-law claims alleging (1) employment discrimination, (2) hostile work environment, and (3) retaliation. Harris contends that the district court erred in rejecting all three claims.   The Eleventh Circuit affirmed. The court wrote that Public Health Trust says that several incidents that occurred at Jackson Reeves shouldn’t be considered because they weren’t caused by Plaintiff’s race. The court wrote that it agreed with Public Health Trust that three of the incidents weren’t caused by Harris’s race and, accordingly, shouldn’t be considered as part of the hostile-work-environment calculus. Further, the court reasoned that even considering Plaintiff’s limited evidence in the light most favorable to her, these are not, given the totality of the circumstances, sufficiently severe or pervasive to alter the terms and conditions of her employment and create an abusive working environment. The Plaintiffs—three doctors, a news website, a healthcare activist, and two states —had posts and stories removed or downgraded by the platforms. Their content touched on a host of divisive topics like the COVID-19 lab-leak theory. Plaintiffs maintain that although the platforms stifled their speech, the government officials were the ones pulling the strings. They sued the officials for First Amendment violations and asked the district court to enjoin the officials’ conduct. The officials argued that they only “sought to mitigate the hazards of online misinformation” by “calling attention to content” that violated the “platforms’ policies,” a form of permissible government speech. The district court agreed with the Plaintiffs and granted preliminary injunctive relief.   The Fifth Circuit granted the petition for panel rehearing and affirmed in part, reversed in part, vacated the injunction in part, and modified the injunction in part. The court affirmed with respect to the White House, the Surgeon General, the CDC, the FBI, and CISA and reversed as to all other officials. As to the NIAID officials, it is not apparent that they ever communicated with the social media platforms. Instead, the record shows, at most, that public statements by Director Anthony Fauci and other NIAID officials promoted the government’s scientific and policy views and attempted to discredit opposing ones—quintessential examples of government speech that do not run afoul of the First Amendment. Further, as for the State Department, while it did communicate directly with the platforms, so far, there is no evidence these communications went beyond educating the platforms on “tools and techniques” used by foreign actors. Parents Defending Education, an association of parents, brought this action to challenge a policy adopted by the Linn Mar Community School District in Iowa. The disputed policy is entitled “Administrative Regulations Regarding Transgender and Students Nonconforming to Gender Role Stereotypes.” The policy sets forth regulations for the District that “address the needs of transgender students, gender-expansive students, nonbinary, gender nonconforming students, and students questioning their gender to ensure a safe, affirming, and healthy school environment where every student can learn effectively.” The parents who seek to participate in this case are anonymous; the pleadings identify them by a letter of the alphabet. The district court determined that Parents Defending failed to establish Article III standing because the organization did not show injury, causation, or redressability on its claims.   The Eighth Circuit dismissed the appeal in part as moot and reversed on one claim. The court concluded that at least Parent G has alleged an injury in fact sufficient to confer Article III standing. Parent G asserts that her son wants to “state his belief that biological sex is immutable.” Because of the policy, however, Parent G states that her son remains silent in school “when gender identity topics arise” to avoid violating the policy. This student’s proposed activity “concerns political speech” and is “arguably affected with a constitutional interest.” Thus, Parent G has standing to bring a claim challenging the policy based on the First Amendment. Louisiana’s Attorney General filed a request for mandamus relief seeking to vacate the district court’s hearing scheduled to begin on October 3 and require the district court to promptly convene trial on the merits of this congressional redistricting case.   The Fifth Circuit granted in part and ordered the district court to vacate the October Hearing. The court explained that redistricting based on section 2 of the Voting Rights Act, 52 U.S.C. Section 10301, is complex, historically evolving, and sometimes undertaken with looming electoral deadlines. The court explained that the district court did not follow the law of the Supreme Court or the Fifth Circuit court. Its action in rushing redistricting via a court-ordered map is a clear abuse of discretion for which there is no alternative means of appeal. Issuance of the writ is justified “under the circumstances” in light of multiple precedents contradicting the district court’s procedure here. The court held that the state has no other means of relief and is not seeking to use mandamus as a substitute for appeal. Further, the court noted that if this were ordinary litigation, the court would be most unlikely to intervene in a remedial proceeding for a preliminary injunction. Redistricting litigation, however, is not ordinary litigation. The court held that the district court here forsook its duty and placed the state at an intolerable disadvantage legally and tactically. TASER International, Inc., obtained an injunction against “Phazzer [Electronics] and its officers, agents, servants, employees, and attorneys; and any other persons who are in active concert or participation with Phazzer Electronics or its officers, agents, servants, employees, or attorneys” (the “2017 injunction”). The injunction prohibited Phazzer Electronics from distributing or causing to be distributed certain stun guns and accompanying cartridges that infringed on TASER’s intellectual property. At the time of the TASER-Phazzer Electronics litigation, Steven Abboud controlled Phazzer Electronics, and Phazzer Electronics employed, among others, Defendant. In 2018, after the district court found Abboud in contempt for violating the 2017 injunction, Abboud and Defendant went to work for other entities with “Phazzer” in their names. Based on that activity, the district court found Defendant (and others) in contempt of the 2017 injunction. At issue on appeal is whether the 2017 injunction extended broadly enough to bind Defendant and prohibit her conduct under the theories of liability that the government has pressed and the district court decided   The Eleventh Circuit vacated Defendant’s conviction. The court concluded that the record cannot sustain Defendant’s conviction.  The court explained that the district court did not make factual findings about whether Defendant was a key employee. Nor did it determine whether she so controlled Phazzer Electronics and the litigation that resulted in the 2017 injunction that it would be fair to say she had her day in court on that injunction.
