Petitioner Lisa McBride was an accountant who worked as Respondent Peak Wellness Center’s business manager for about nine years. Peak terminated her in 2009, citing job performance and morale issues. Petitioner claimed she was terminated in retaliation for bringing various accounting improprieties to the attention of Peak’s Board of Directors. Petitioner brought several federal and state-law claims against Peak: (1) whistleblower retaliation under the federal False Claims Act (FCA); (2) violations of the federal Fair Labor Standards Act (FLSA); (3) breach of employment contract; (4) breach of implied covenant of good faith and fair dealing; (5) defamation; and (6) a federal sex discrimination claim under Title VII of the Civil Rights Act. After discovery, Peak moved for summary judgment on all claims, and the district court granted the motion. Petitioner appealed, arguing that significant issues of material fact remained unresolved and that her claims should have proceeded to trial. She also appealed district court’s denial of an evidentiary motion. Finding no error in the district court’s decision, the Tenth Circuit affirmed its grant of summary judgment in favor of Peak.

Plaintiff sued defendants, the City and the Zoning Board, for violations of the Fifth Amendment Takings Clause and for denying her procedural due process and equal protection under the Fourteenth Amendment. The Board had decided to revoke the permits it had given her to operate her Sno Cone hut at a certain intersection. The court held that the district court was justified in dismissing plaintiff's equal protection claim where plaintiff failed to state a viable equal protection claim. The court held, however, that the district court erred in dismissing plaintiff's procedural due process claim where plaintiff's property right in the business permits the Board granted to her merited the protection of procedural due process before the Board revoked it.

Plaintiffs, Western Tradition Partnership (WTP), Champion Painting, and Montana Shooting Sports Foundation (MSSF), sued the Montana Attorney General and the Commissioner of Political Practices, seeking a declaration that Mont. Code Ann. 13-35-227(1) violated their freedom of speech protected by the state and federal Constitutions by prohibiting political expenditures by corporations on behalf of or opposing candidates for public office. The district court declared the statute unconstitutional, granted summary judgment for Plaintiffs, enjoined enforcement of the statute, and denied the motion of Champion and MSSF for an award of attorney fees. The Supreme Court reversed and entered summary judgment in favor of Defendants after applying the principles enunciated in Citizens United v. F.E.C., holding that Montana has a compelling interest to impose the challenged rationally-tailored statutory restrictions.

The issue before the Tenth Circuit in this case pertained to a "class-of-one" equal protection lawsuit against a county government based on its demand that a property owner correct a nuisance. Kansas Penn Gaming, LLC alleged that after it and Cherokee County became involved in litigation concerning a casino development agreement, the County health department targeted Kansas Penn for a regulatory enforcement action. In particular, the County sent Kansas Penn a notice stating that the unkempt condition of its property violated state and local nuisance laws and regulations and warning that failure to clean up the property would lead to an enforcement action. Although the County never brought an enforcement action against Kansas Penn, Kansas Penn sued the County and some of its officials under 42 U.S.C. 1983. In its complaint, Kansas Penn alleged the notice of nuisance violated its right to equal protection by arbitrarily and maliciously singling it out for selective enforcement. Because the Tenth Circuit agreed with the district court that Kansas Penn failed to state a claim for relief under the standard set forth by "Bell Atl. Corp. v. Twombly," the Court affirmed dismissal of the complaint.
