The Second Circuit reversed the district court's grant of summary judgment in favor of ACE on its claim that the decision not to renew its precious metals license violated procedural due process because it was made without adequate notice and opportunity to be heard. The court held that ACE was not entitled to summary judgment on this procedural due process challenge because Connecticut law did not afford it a constitutionally protected property interest in the renewal of its precious metals license. Therefore, the Town was entitled to summary judgment on this claim.
